Could you please help. I'm a US citizen. My fiance and i have been living together in the US for the last 2 years. He entered the US illegally 5 years ago. We want to get marry, and of course start the process for his papers. We are not sure if he should go back to mexico and then fill out I-129F then K-1 visa or get married here in the US and then he go back to mexico and then fill out I-130 then K-3 visa. Also not sure if he will be charge a penalty or have to wait longer in mexico for any visa, for entering the US illegally 5 years ago.Thanks so much for your help.
