I have applied for the K-1, I-129 F, Visa in October for my fiance. She is from England. There is one concern though. When she was getting divorced, her ex-husbands girlfriend attacked her outside her son's school. Although the altercation was brief, my Fiance was convicted of and I quote: "Abusive language with the intent to cause harm". Will this charge keep her from being granted a K-1 I-129F visa? I know when i filled out the application, they asked about felonies, and she never actually hit the woman, but both were convicted of the same thing. Neither one got jail time but were put on probation for 2 years. She completed that with no problems and has no record, even a traffic offense beside at one incident. What is the probability she will be denied her visa? Thanks for you help.

I have one more question relating to the previous question. Because she had this conviction, apparently she was to get some special visa to come to the USA to visit me. Now England as you know is under the visa waiver program and we assumed this was OK and never considered her conviction a problem because it was so minor. However, now we are concerned that when she goes for her consulate interview in London, whenever that will be, they will see she has this conviction, didn't get the special visa, and came to America and deny her the K-1 visa to marry me. Is this very likely at all in your opinion?
