  • K1 visa time line

My fiance lives in Australia and I have so many questions.

fiance visa or spouse visa? which is faster? how long does it take?
    do i need a lawyer?
what if we got married over there?

I know there are tons of people that get married to foreign nationals all the time but why does it seem so hard.Every time I look at the information for the visas I get a headache.HELP!!!

We heard that K-1 takes a little less time than K-3, but not by much. I know there are some advantages to each, but I'm not too sure what each of them are.

The length of time really depends on many things, but I remember hearing it takes about 6 months. We got lucky - it was less than three months. Some people have to wait a very long time, but things can be much faster if you make sure to almost 'overdo' everything.

I'm sure many people are successful without a lawyer, but we feel it helped us to have one. We think it helped speed things along. It helps to show that you're serious, and you have the benefit of someone who knows the process (we were a little nervous about doing things wrong). They are expensive, though. If you can afford one, get one. I don't know if anyone can tell you about the online services such as VisaPro (we have no experience with them). If you can't afford one, don't panic - it's not a requirement, and I'm not even sure how many people actually hire one. We had much of our help from people who have been through the process before.

It's so hard because the government is worried about national security and marriage fraud. That doesn't make it any more enjoyable for us though!

Just keep with it - remember that K-1s are rarely denied. As long as you can prove that you have enough financial support, and are in love, you will be successful. It just takes time and patience.

    Best of luck!

      pending..

My fiance and I are going through the process right now, but prior to applying, we have done some extensive research. Answers to your questions, in our experience, are that the fiance visa is faster to obtain. I can't tell you how long it takes because each case is different, but make sure you follow ALL the directions very closely. It is better to get married in the US. No, you don't need a lawyer, but you may consult with one if you want to. You can do it all on your own, it just takes a lot of paperwork.

      Good luck!!
