  • How long does Admin Processing take?

My K1 interview was on feb 21st and i was asked to submit more proof of our relationship. One week after the interview when my fiancee contacted the consulate they said our case is kept under admin processing and they will contact us when action is needed.

my question is how long does it usually take for the admin processing to complete? i knows its not possible to say the exact timeline, however can any one please tell me how much delay we can expect ?

aint there yet, we just got approved last month & still waiting for the packet 3 but i think they need to be convinced a little more so they asked for more proof. have you sent them what they asked you? didn't take longer for most but lack of evidence will cause further delay. make sure u sent them everything they need.

        Sushith,

Did you get the K-1 visa.
Could you tell me what they ask in the interview. What additional document you had to provide for proof of relationship.

        Good luck.

My Interview was on Feb 21 2007 and it has been more than a year now, Finally I got a call from bluedart saying that I have a passport package from the consulate. I asked them whether the visa is approved or not, they said they can't say cos the package needs to be opened to know whether the it was approved or denied. I am in another city right now and will be traveling 15 hours to get the package from my hometown. I tried to call the consulate but they are closed since its the weekend. I am really anxious to know if my visa was approved or not....Damn this situation doesn't feel good at all..

Why did it take more than 14 months to complete the administrative processing btw...

              Sushithmn,

Please keep us updated of your situation; 14 month of administrative processing is pure insanity. My Fiancé’s interview was May 27, they told her that they did not need any more documents, but we are still waiting for visa. Our wedding is for July 5, and it looks like we have to cancel.

14 month is for the CIS only processing. If the consulate has requested an FBI name check, with all the backlog they've got, he may be looking more at close to 2 years.

I went and picked up the package sent to me by the consulate, It had the following enclosed in it.
                    • All the documents and photographs submitted to the consulate via VFs (Proof of relationship--Emails, Letters, Hotel Bills, Phone Bills, Photographs etc)
                    • My Passport
                    • A White Handout 221g stating the following--Unfortunately we are not able to issue the visa to you because the petition expired on {date} and was not reviewed. We've sent the petition back to USCIS for possible revocation. All further queries regarding this case should be routed to USCIS.

We did email them earlier asking the same and they kept saying that the case is under AP and we will contact you when its completed, Aren't they supposed to let us know that the petition is going to be expired and should be renewed?.

From what I read "Consular officers have the authority to extend the validity of petitions that have expired"

So I was expecting them to atleast contact when the petition has to be renewed.

Me and Me Fiancee tried to email the Consulate, No Replies yet, She had tried calling USCIS And left voice mails and no call backs yet.

What are we supposed to do now? Or what we can do now? Is it the end of the story? Any advice much appreciated.

And the funniest things is that my fiancee emailed the consulate requesting an extension of the petition before it was expired (It was to be expired on April 17 and she emailed them on April 14) and this was the reply that she received..

The case is being held up for admin process. Please wait for us to complete the same and then get back to the applicant.

So can they Issue a 221g stating that the petition was not renewed?

Not true. Only USCIS can extend a petition.

If only USCIS can extend the petition why didn't the consulate tell us to approach them when we emailed the consulate for the extension of the petition...

                            I think u r inaccurate

Consular officers have the authority to extend the validity of petitions that have expired. Because many petitions often expire before an applicant can be interviewed, officers at the Consulate routinely extend the validity of K-1 petitions.
