  • Money in my bank account for fiance

    Hi,

    I have a question my fiance is going for a interview in 4 weeks. I would like to know how much money do I need in my bank account for the interview? They said I need some money but I do not know how much. My fiance has 10,000.00 US dollars in her account but I have less then 10% of that. Do any one know how much I need in my account? I just got out of the military 6 monthsand move back to America and I am starting to get everything back to normal money wise and I made a new bank account. She is waiting on me to send my bank information but I am worried I will not have enough and they will deny her. I hope someone out there can help me. Thank you, have a great day

    I dont think that's one of the requirement since your fiance is not supposed to furnish any documents that relate to your assets at the time visa is issued. Your assets would need to be furnished when you apply for her adjustment of status.

      what do you mean adjustment of status? They said they need a letter from my bank with account information before her interview and it is also said I need to have a sufficent amount to support her. I am now doing the AFFIVAIT OF SUPPORT right now that is the form I read that says that. Do you go through this too with your fiance? Thank you for your help

The only reason you need assets is if you dont qualify with income. Like if you only made 10 grand last year , but you have 300 grand in the bank , etc . Even though the K visas are considered non-immigrant visas, they are still processed as immigrant visas. Thats why you have to show that you can support her. If she is in Philippines ,all she needs is your tax return. For a family of 2 , which will be you and her , you need to have made around 19 grand in 2006

        Thanks I appreciate it. I made over 24grand last year. We are doing our paperwork soon. I am worried they might not approve her. Right now I make a lot more money then I did last year but I dont have much in the bank and that is my concern. Thank you.

          Actually for the I-134, you also need to have your most recent income tax return and a letter from your employer, stating what your current position is and your yearly salary. So, yes, they do want current information. As far as income recuirements for K-1 sponsorship, you need to be making 100-125% above the DHHS (Dept of Health and Human Services) published Poverty Guidelines. It really depends on the consulate what they will accept, but since for the later AOS process and the I-864 (the more detailed financial Affidavit of Support which you file for getting residency) you need to meet 125% of the poverty guideline, some consulates want to see that you make that much. Google "2007 poverty guidelines" to get current figures.

            Thanks alot I really appreciate that. that is so much information that I really needed. So does it matter how much money you have in your account?

              No it does not matter the current amount you have in your bank account, but some consulates do ask for a letter from the bank establishing when you opened your account(s) w/ them and what your average balance is. In fact it is one of the supporting evidence(s) that can be used to support your I-134....look at the instructions on the form. It is not a matter of having to prove a large amount of money exists in the bank account. The consular official adjudicating the visa is looking at the petitioners overall financial situation to gauge if he/she can support (in the immediate long-term) the intending immigrant. Keep in mind that the condition of the K-1 visa is that the recipient enters the US, marries the petitioner w/in 90 days and then files to adjust status. The whole process can take up to a year (could be longer) from time of filing for AOS....so the consulate is looking to see if you as the petitioner can support the visa beneficiary during that process and that the beneficiary does not become a "charge to the state".

                Oh I see, Well I make enough to support her. Thanks that really helps me out alot and it calms my nerves.
