  • Please Help.. My Case Was Returned For Investigation

    Hi Friends.
    My Fiance And I Had Our Interview Six Month Ago In The Dominican Republic. The Lady Who Interviewed Us Didn't Believe That Our Relationship Was Real. This Is A Relationship That Started In 2001. In 2004 I Became An Us Citizen And In 2005 I Sent My Petition (i129f) It Was The Fastest Way To Bring The One You Love To This Country At That Time.
    The Lady Denied Us The Visa Because She Said We Did Not Have Enough Evidence. I Brought Pictures,phone Bills, Leters,reciets Of Money I Sent Her, My Old And New Passports So She Could See That I Travel Every Year To See Her. She Only Wanted To Ask Questions And She Ignored My Evidence. She Asked About 100 Questions And Contradicted About 80 Of Our Answers. The Denied The Visa Under Section 221g
    Right Now My Case Is In Vermont. It's Been There For Six Months And There Is Not Way I Can Contact Them. When I Call The Uscis, They Often Give Me Wrong Information About My Case And They Contradict Themselves Verymuch. This Situation Is Driving Me Crazy And I Have Spent Most Of My Savings In It. I Have Seen Lawyers,congressman,immigration Specialists And Nothing Seems To Work. I Believe That Something Has Been Mishandle In This Process. I Have Also Heard That There Are A Lot Of Corruptions In That Embassy In The Dominican Republic And In Many Others Embassies.
    Please, If Anyone Can Give Me An Idea On How I Can Work This Out, It Would Be Strongly Apreciated.

BUT HERE I AM FREE. THE SAD PART IS THAT THEY DO WHAT EVER THEY WANT BECAUSE THEY ARE PROTECTED BY THE GOVERMENT. I AM FILING A COMPLAIN RIGHT NOW. BECAUSE THEY MADE TWO BIG MISTAKES. EVEN THE PRESIDENT WILL HEAR ABOUT IT.
    PLEASE IF ANYONE CAN GIVE ME SOME INFO OR IF ANYBODY HAS EXPERIENCED THE SAME, PLEASE LET ME KNOW WHAT CAN BE DONE.

      thank you guys for your information. this is very hard to be in this situation. i just hope that they find the true soon, because i have nothing to hide. i am paying a lawyer to find the fastest way out. i can't travel now to marry her because of my job and becasue it might take longer than if i appeal this case. i will let you all know how it's going. at the mean time, i will apreciate any other info that apply to my case.

WHEN THEY SENT US FOR INVESETIGATION, THE GUY WAS LIKE TRYING TO GET ME TO THE POINT WHERE PEOPLE OFFER THEM MONEY. HE MANY TIMES ASKED ME ( WHAT DO YOU WANT ME TO DO FOR YOU? ) IN THE DOMINICAN STILE OF TALKING YOU KNOW AND I KNOW WHAT THAT MEANS. ALSO, EVERY DOMINICAN KNOWS WHAT'S GOING ON IN THERE. IT IS " POLITICA" I FORGOT TO SAY THAT BEFORE THE INTERVIEW, THEY ARE SUPPOSED TO SEND YOU THE PACKAGE OF INSTRUCTIONS AT LEAST 30 DAYS BEFORE THE INTERVIEW. AND THEY NEVER SENT IT TO US. THEY TOLD US TO GO AND GET IT AT THE EMBASSY. THAT'S IS NOT THE WAY IT WORKS. SOME PEOPLE GET THEIR INSTRUCTIONS SOME TIMES 2 MONTHS BEFORE THE INTERVIEW.I AM AN U S CITIZEN WHO WORKS AND PAYS TAXES HERE AND AS U S CITIZENS WE SHOULD GET TREATED BETTER. AND BELIEVE ME, UNITED STATES NEEDS MONEY RIGHT NOW AND THEY HAVE TO FIND THE WAY TO DO IT AND THIS IS ONE OF THEM. MAKING THINGS HARDER FOR THOSE WHO ARE TRYING TO DO THE THINGS THE RIGHT WAY.           you are correct my friend.

          you are correct my friend, it is unthinkable what they get away with. it might sounds crazy, but i think they set people up to deny them the visa.
          for example, they told me that i did not have enough evidence. they said that because they ignored all what i brought to them. they were asking me questions about her grand parents and things that are not related to a relationship and things that they knew that i might didn't know. they could have given me at least 30 days to present more evidence,but they returned my case for investigation. one week after the interview, they sent us a leter accusing us of fraud. they are saying that our relationship was just for immigrate to US.
          i have nothing to hide and i have proof and thousands of witnesses of this relationship. in the other, they will find nothing to prove that this relationship of seven years is ****. if i am commiting a fraud, why am i still here free with out any charge? it doen't make any sence.
          you made a very important point my friend. i never thought of that. that's why i like this web page. we can learn so much here.
          well, lets keep on waiting and see what they want to do to us and our cases.

            Let's Get To The Point Please.

            please friends, don't take it so personal. we are trying to get answers to our immigration questions and problems. you both seems to know a lot about this process and it is interesting to read your inputs,but I THINK it is going to the wrong direction.
            i just wanted to say something. i have friends that had seen their fiances only one or two times. when they went to the interview, they only brought one single picture that they had taken one night THAT they went to eat to a restaurant. they did not bring any rings or leters. they did not have any phone bills or anything like that. they went there empty handed. and guess what? the interviewer only asked then one single question and gave them the visa. ( where did you guys meet?)that was the question and that was all. my friend was recently divorced, paying child support, and he is like 15 years older than her. now, she came to this country in about 4 months after their petition got aproved. they already have a child here and they are SO happy. i am happy for them too.
            the point i am trying to make is. that i meet my girlfriend in 2001 and i was not an u s ziticen at that time. i became u s citizen in 2004. in 2005 i sent my petition. it got aproved in less than 2 months,but i waited 18 months to finally get an interview. i had and still have pictures( like 50 of them of us together) VIDEO TAPES OF US TOGETHER. leters( hand written and also e-mails) phone bills,receipts of money that i sent to her, proof that i travel every year to see her( some times twice a year) and i also went to the interview with her. to make the long short, the attitud of the interviewer was just unexplainable. she was a lady and it seemed that she had her day. to make it worse, the mic and the speakers in that cabin was cutting off the interview very often. when i could not hear very well what she had said, i asked her to please repeat the question and she was getting kind of mad. at the end of the interview,after 10 hours in the waiting room,going in and out, she just told us that we did not present enough evidence to convince them that it was a real relationship. she also said." i am very sorry, i have had a very long day and i have other cases to take care of. you can appeal or get marry and come again." she did not show a bit of profectionalism. to me it was very hard to hear that. because i am doing everything by the book and i have done nothing illegal. one week later, we recieved a leter from the embassy accusing us of fraud. it said that our relationship was just to immigrate to U S. and that my case was going to be investigated. that investigation according to the uscis, takes 120 days. right now, it's like 200 days passed by already and i get nothing from them. when i call the uscis, they just give me wrong information and they say that they appologize for that. their appologies does not help anybody. i don't know what is wrong with this people and this system.
            if you compare, my friend was recently divorced and paying child support when he met his fiance.( i have never been married and i don't have kids.) i am only 6 years older than my fiance.( no 15 years) he had met his fiance for less than a year when he went to the interview.( my fiance and i had been with this relationship for 5+ years when we went to the interview) i brought lots of proof and evidence.( he only brought one picture) i got asked like 100 questions.( they asked him only one ).him and i work in the same company. we have been in that company for over 10 years and we make over 30k a year. enought to support a fiance while things get in order.
            my main point is, i think none of us on this web page know for sure what or where the embassy is realy based on. with all the corruption going on all over the world it is hard to know that. i just gave you the differences between my friend's case and my and the results. noone on earth knows how i feel and how much it has effected my life and my fiance's. if things keep on going this way, i might get my things together and get out of here. we become U S citizen to better our lives and get the rights that the constitution gives us as american and tax payers in this country, but the fact that we come from other countries is still the same. america only knows that we are U S citizens when we show up to vote and that's it. in the mind of most americans, when they see a none white person, they think that we might be illegal or bad people. i have heard that my own from white people. i will make it clear. i have nothing against them, but those who talks like that, would be a lot happier if we "the none white people" get stamped in our forhead saying our immigration status. jajaja. this my sound like a joke , but i know most of you who come from other countries will agree with me. and some americans too.
            just to be a little more the american way. ( what we "the immigrant" go through to better our lives and do the things right, that's something prices less. the worse part of all is: ( MASTER CARD IS NOT ACCEPTED AND VISA DISCOVER AND ALL OTHER MAYOR CREDIT CARDS GET REJECTED).
            It would be nice to be in a world where people understand each other a little better. unfortunelly, things are getting more complicated to understand.

              sorry to hear your story. i can only say that it depends on the consular officer's judgement. if u get lucky, consular dont spend much time asking alot of questions. few questions he/she can ask and they can figure out if they approve you or not. doesn't matter how complete your evidence were but will surely help your application. if u're unlucky, you will be interviewed by a consular who ask questions from A-Z about your relationship. they ask alot of questions, yeah thats right, and questions u least expected only to investigate how deeply u know the person u claim your fiance. if u were dating or in a relationship say for morethan 1 year, the consular is expecting that you already know his/her family background and the ones connected in his/her life. they expect that you know each other and the longer your relationship are the higher the consular might expect from you.

              Tell you what, i had an interview on june 15 for K1 visa and didnt even take 5 minutes the consular already approved my application after simultaneously asking me like 10 questions i can hardly remember now lol. Sure he asked for unexpected questions about my fiance, but since i know him in almost 2 years now, i had no difficulties giving him answers. after the Q and A, the consular just said that he had no further questions, that he was satisfied with my application and have approved my papers. he even hand me back all the pictures i printed out as evidence after looking at them plus the emails letters etc said that he dont need it nemore and he thought i need it for my scrap book haha.! he was nice and even wished me a happy life with my fiance in the U.S. here see the difference.... there is this girl that i talked to at the waitng area, said that she was interviewed by a female consular officer and didn't even say a thing just asked her to leave and wait for her name to be called so she didnt know if she was approved or not. so again, i think it depends on the consular's judgement and how he/she is and nothing we can do about it.

              i really feel sorry for what had happened to your case but i can only suggest to move on and do the next thing to get your fiance in your arms. yes you may try contacting the embassy but while doing this and waiting for them to reply to you, you may either refile or get married and apply for K3 instead. easier said than done but what can you do right? goodluck.
