    I currently in the US on a visa waiver, I have been here two months. Whilst visiting here over the last year, I was offered a great job here. I applied for the O1 visa, got approved and am due for an interview in London next month. Of course it isnt guaranteed.

    Whilst here on a previous visit I met a girl. For the past two months we have been dating regulary.She is amazing. Both of us are really worried in case I get denied and am stuck in the UK.Yesterday SHE asked me to marry her.It took me by suprise but I accepted. Since I came here legally with NO INTENT to marry,can we get married and I dont have to fly back to the UK after my visa waiver expires?
    Do I then I apply for a work visa?Which means I can then take the job I was offered?

    advice

    Before I can give any suggestions or advise we should be clear whether the girl you are getting married is a citizen of US or she is under any other non immigrant visa. So that advise would become easier. If she is US citizen she can file for Green Card family based for you. Or if she is under Non immigrant visa you can apply for a dependent visa for you. After clarification I would be in a better position to give you proper guidance about the next step.

          Thanks for the advise. Our problem is we only met,now nearly 3 months ago, how can we possibly provide any back history to our relationship as proof? We dont have any, apart from pics taken in this short term?

            There is not a cookie-cutter recipe mold perfect marriage for USCIS... meaning, your relationship, if it is true, it will show.

            You still have another month before getting married and filing for AOS, then another 3-4 months before the interview, you have time to start building up evidence... pictures, bills, leases, etc.

                Your overstay will be forgiven, once you file for adjustment of status.

                You do not have to rush into the wedding, just keep a low profile (do not be getting into trouble) and do file for AOS at least within the next 2 months (to prevent accumulating more than 180 of illegal presence, therefore being subject to a 3 year ban if you leave the US before you get the GC).

                  I think you run a real risk of being deemed to have entered into the marriage for the purpose of immigrating to the U.S.

                  First, you overstayed your visa.... (or are about to)

                  Then, you married someone shortly after meeting them...

                  Consider this scenario from USCIS' point of view...

                  Please note, if you reach the 180 day mark (in terms of your overstay), it will be some time before you can leave the U.S. again...

                  Don't plan on visiting friends and family in the near future.
