I am a GC holder currently, and just file the N-400 for the citizenship. In this summer, I got married and my husband is in China now. I'd like to file I-130 for him. Some people say that I should wait till I got the citizenship to file, it will get the faster process? Is it true?

You can file the petition for your husband on K-3 basis as this faster than the Green card process Once he is in US he can very well apply for Green Card after stipulated time. With this he can be with you sooner than any other mode. The K3 visas generally have shorter waiting periods compared to marriage-based immigration visa petitions. You can apply for a work permit by filing Form I-765 and engage in employment.You can remain in the U.S. while you wait for the approval of the Form I-130 and are able to apply for lawful permanent residence status (adjustment of status), or for a green card, instead of having to wait outside the U.S. as the law previously required.Last edited by Anjelo; 08-18-2007, 09:28 AM.
