    HELLO I HOPE SOMEONE CAN HELP ME HERES MY STORY I AM A U.S CITIZEN LIVING IN MEXICO WHERE MY BOYFRIEND WAS DEPORTED A COUPLE YEARS AGO WE HAVE BEEN TOGETHER FOR A LONG TIME NOW AND WANT TO GET MARRIED I WANTED TO GET MARRIED IN THE U.S SO HE DECIDED TO FILE FOR HIS VISITORS VISA SO WE CAN CROSS OVER FASTER AND HE WAS SADLY DENIED DO TO THE FACT THAT IN THE PAST HE HAD OVERSTAYED HIS VISA AND GOT A DUI IN THE US AND DEPORTED WE BOTH REALLY WANT TO GO TO THE US AND SO THAT ISNT HAPPENING ANY TIME SOON I HAVE DECIDED TO GET MARRIED HERE IN MEXICO AND THEN FILE FOR THE FIANCEE VISA SO WE CAN GO LIVE IN THE US I HAVE NO PROBLEM PROVING THE RELATIONSHIP FOR THE VISA BUT WILL HE GET DENIED AGAIN FOR THE DUI AND DEPORTATION PLEASE ANYONE HELP WE ARE YOUNG AND HAVE NO CLUE WHAT TO DO WE ARE THINKING OF GETTING MARRIED WHERE WE ARE AND FILING FO RTHE VISA IN ANOTHER STATE CAUSE THEY ARE MORE STRICT WHERE WE ARE AND ALSO DO I NEED TO BE MAKING A CERTAIN AMOUNT OF INCOME WHICH I DONT HAVE FOR LIVING IN MEXICO HOW MUCH IS THE PROCESS AND HOW LONG WILL IT TAKE ANY FEEDBACK WILL DO PLEASE THANKYOU

    K-3 Fiance visa

    After getting married you cannot file for K-1 visa as it is specifically for Fiance(e). Being you have no hurdles getting into US. after getting married to your boyfriend you can travel to US and file petition for your Husband i.e. K-3 visa which is a more quicker than the Green Card Family Based.

    The K3 visas generally have shorter waiting periods compared to marriage-based immigration visa petitions

    You can apply for a work permit by filing Form I-765 and engage in employment

    Your children can accompany you to the U.S. on the K-4 dependent visa as long as they are named in the visa petition
    Requirements for the K3 Visa

    You may be eligible to receive the K3 visa if:

    You are legally married to a U.S. citizen

    You have a family based I-130 immigration petition filed by the U.S. citizen spouse on your behalf

    You seek to enter the U.S. to await the approval of your green card petition and subsequent lawful permanent resident status

    Applying for the K3 Visa

    Before you apply for the K3 visa, your U.S. citizen spouse must file Form I-130 on your behalf with the U.S. Citizenship and Immigration Services (USCIS) service center that has jurisdiction over your place of residence.

    Your spouse will then receive Form I-797, Notice of Action, indicating that the USCIS has received the Form I-130. Your spouse should then file on your behalf a copy of this Form I-797 along with a USCIS Form I-129F to the following address:

    U.S. Citizenship and Immigration Services
    P.O. Box 7218
    Chicago, IL 60680-7218

    The USCIS after adjudicating the Form I-129F forwards it to the appropriate American Consulate so that you can apply for the K3 visa.

    Duration of Stay

    You can remain in the U.S. while you wait for the approval of the Form I-130 and are able to apply for lawful permanent residence status (adjustment of status), or for a green card, instead of having to wait outside the U.S. as the law previously required.

        For how long did he overstay his visa?

        If he overstayed between 6 months and 1 year he is banned from returning to the US for 3 years.

        If he overstayed more than 1 year, then he is banned from returning to the US for 10 years.
