  • Apply SSN question

    My wife entered in US on Sept 16 with K1 Visa. Then, we are married on Sept 20 right away. Now, I am going to fill out the SSN application for her (should I wait a little bit longer?). But I am not sure how to answer for question 3.

    (3) Citizenship (Check One)
    • U.S. Citizen
    • Legal Alien Allowed To Work
    • Legal Alien NOT Allowed To Work
    • Other


    Which one should I choose ... should I choose the second answer or the third one?

    She is a "legal alien not allowed to work"

    Technically, she is allowed to apply for a work authorization (EAD) during the 90 days of her entry to the US in a K-1 visa.

    However, since she will be adjusting status, and file for EAD anyways... for now apply with the "not allowed" option... then once she receives the EAD or the GC she can have that changed on the card. But having the SSN already will allow her to get a Drivers License and all.
