  • K-1 process not following the script?

    I've done a lot of reading on the K-1 process, but what is actually happening now in my case isn't what I expected, and so I'm not quite sure what to expect next.

    My K-1 was approved in California, sent to the NVC where it stayed for about a week before being sent to the embassy in Moscow (my fiance is a Russian citizen). I called the embassy, and they said they had received a "cable" that the petition was on its way, and that I should wait until the first week in November before making more inquiries.

    To my surprise, before anything else happened, our petition number appeared in a list of interview appointments on the web site maintained by the embassy - my fiance's interview is set for December 3. We have filled out the forms required for the interview per instructions on the web site, and I have them ready to mail to her as soon as I finish putting together the proof that I can support her.

    This is not the same process I have read about. It is much more streamlined than I expected. It seems too good to be true, but it would appear that on December 3 my fiance will hear the final decision on the petition, which I cannot imagine will be anything other than approval, and then she will receive her visa in a day or two via DHL. It is entirely possible, perhaps even likely, that should could be with me by December 8!

    So my question is this: are there any additional steps or delays lurking in the shadows? Would it be very ill advised for me to make a flight reservation for 12/8?

    Hy,

    My name is Dana - me and my fiancee are waiting for an answer from USCIS for the same thing that you were waiting. How long took them to process your documents - I129 F form ?
    We sent the documents in june and on june 27th, 2007, received the receipt at home- i meen his home- the one that they send to you for paying that procesing fee. From that moment one we didnt have any sign from them.

          k-1 visa process not following script?

          Please remember than an approved petition in USA,does not guarantee a visa Issuing.The person applying for the K-1 visa, must attend an iterview at her or his home country USA embassy.If everything goes well at the interview and all documents are in order,he or she will be granted the visa and he or she have 6 months to enter the USA to get married.(Within 90 days).
          What I am trying to say is that the interview abroad will be the final decision on a visa being issued,denied or rejected.That is why he or she must be well prepared for this phase of the visa process.It could be very tricky and frustrating.Trust me.
          I am having some problems myself with a k-1 visa.I have posted my situation.

            I recommend that you wait until your fiance receives the visa before you make flight reservations. Each embassy's processing time is different. As a result, there is no guarantee as to when your finance will actually receive the visa. My fiance completed his embassy interview on 25 March. We are still waiting for notification as to whether his visa is approved or denied.

              I am just curious.My fiancee also had her interview about 3 weeks ago,and we are still waiting for an answer.Did he have any problems with his documents, with the questions they asked him or anything like that? What did they said to him at the end of the interview? Can you explain please?

                My fiance did not have any problems with his papers or the interview. During the interview, they asked questions about how we met, how long we've known each other, etc. They also asked him to show photos of us together. Everything they asked was information that was already included in our petition. At the end of the interview, they told him to go home and wait for the decision. Unfortunately, the embassy is very slow in processing. I met another couple on this website whose interview was at the same embassy. Their interview was one week after my fiance's, and they have not received notification of visa approval either.

                Much like yourself, I initially thought the process seemed too easy. Everything seemed to go smoothly until we reached the administrative processing phase. Now we wait.

                  I guess we are in the same situation .May I ask where was he interviewed?
                  My fiancee is from Chile.Have you get in touch or contacted the embassy about the delay? Do you have an attorney? 2 weeks after the interview I e-mailed the embassy asking why the delay,and they said that they will forward the message to the officer reviewing my case.That was it.Have you have the same experience?

                    My fiance interviewed at the Cairo Embassy. I have contacted them every two to three weeks since the interview, but the response is always the same "Your case is pending administrative processing. We will notify your fiance when processing is complete". My Senator also made an inquiry on my behalf but received the exact same response. We did not hire an attorney, but everything is fine with our paperwork. Unfortunately, I don't believe the embassies are required to adhere to a processing timeline. As a result, we are at their mercy.

                      Well,I tell you what cats.I am not going to stayed here with my arms crossed,waiting for them to call my fiancee.I have an appointment tomorrow with an agency that only specializes in k visas.These are a group of immigration attorneys and they have many many years of experience in this field.Most of the time the initial consultation is free,and aftrer that you have to decided on what you want to do.Even known I have an attorney,he is not giving me the support that I need in resolving my case at the moment.
                      I have the feeling something must have went wrong with some of the questions they've asked him.When a case is submitted to "administrative processing",it means that they need to make sure your relanshionship is genuine and they need to investigate deeper into your case,which in turn,it will take a while to process.I would not be surprised if that is my case too.

                      My advise to you,ask a qualified attorney.Who knows?We just can't give up that easy.If there is something that can be done,I am sure they would do it.

                        Usually between 3 to 6 months,assuming all paper work has being filed correctly and there is no problems with the petition.Sometimes the state where you live and the country where the fiancee or fiance resides,may speed up or delayed the process.
