  • Issues with NVC and processing of I129F

    A little background on my case and hopefuly somebody can guide me in the right dirrection.

    On 24 August 07 I received the approval notice from the USCIS for the I129F, I'm sure you know that the notice says that it will take from 2-4 weeks for them to respond. After the 4 weeks had elapsed I contacted the NVC, I was told that they had no record of my application. After that I contacted the USCIS and after several calls I was allowed to speak with one of their supervisors, at that time I was told that they will send the application one more time to the NVC. The application, aparently was sent again on 25 September 07 according with the second I797 that I received stating that my case was approved on 24 August 07. as of Today the NVC still saying that they have no record of it.

    The most frustrating part is that the USCIS tells me that they can not do anithing about it because the allready sent two copies to the NVC, The NVC tells me that they can do nothing because they don't have it. And neither of them will try to locate it or research if in fact it was mailed from USCIS or missing from NVC. I'm in the middle of this issue and feel helpless.

    I contacted my Congressman with the issue about three weeks ago, they started an inquiry, but neither the USCIS or the NVC have answered yet.

    I have mailed and emailed the NVC and sent them copies of the I797, their reply was to get with USCIS because is their issue and not the NVC. USCIS tells me to get with the NVC because is their issue and not the USCIS's issue.

    if anyone have an idea of anything I could do in this case it will be appreciated.

    I have the feeling you have done all this on your own,without having an attorney filled out the petition for you.Am I correct?If I am not,please disregard this advise. It Is not surprising that stuff like this has happened to alot of people when they do not have legal representation on their side.
    I understand that immigration attorneys are not cheap,but if you want things to go smooth and with the less amount of trouble,it is the only way to go.
    Right now you are in a bad situation.USCIS says they sent the petition,while NVC says they don,t have it.
    There is not much anybody can do for you at this point unless you get some legal representation to see what is going on and possibly find out what ever happened to your petition.USCIS and NVC can play this game forever,and there is the possibility that you would never know what really happened to your approved petition.(Believe me I hope I am wrong and that everything turns out ok for you,but honestly,it does not look good at this point) Just my opinion.
