  • Question about K-3

    Hi, i have few questions!
Can you send the I-130 form and the I-129f at the same time or do you have to wait for the Notice of Action?

Also, i have been married since June back in my country. My husband filled out the G-325A and signed the date since then? Does it matter what date the form was filled? Does it have to be like 30 days or less or something of that nature? Or do we need to have him fill out a new form.

Thank you in advance for you help.

No. Send the I-129F form after Notice of Action (NOA) acknowledging I-130 petition received along with copy of NOA.

Yes, it does matter, if there is any change like those that traveling, number of days at present address and employer, changes in address, etc (especially there is time gap since June). All you have to provide current info at the time of sending forms to USCIS.

For info on K-3 visa please read following link:

Thank you very much, i still have a question. Is the K-3 still faster than the I-130? It says six months on the USCIS website for both but I don't really trust USCIS after waiting two years for my citizenship to be cleared.

Both of them have almost same approval period but sometimes K-3 visa is faster than counselor processing (not I-130). Counselor processing is cheaper than K-3 where you have to file your spouse adjustment of status while he/ she in USA on K-3 visa.
Do not forget K-3 application will consider after you send I-130 form along with supporting documents to USCIS and after receiving acknowledgement letter for I-130 (NOA for I-130), you have to send I-129F form along with copy of NOA to USCIS.
