  • K3 after marriage in Mexico

Hi all, just a few questions.

I am a citizen, my wife and I were married in August, in Mexico. I have now returned and was told I had to file for what I understood to be the K3 Visa. I had to send in the I-130 along with the G-325A for her and me. I sent those in around the 4th of October.

How can I know the status of my papers, to my understanding I will receive a confirmation, but how do I know they have actually received the papers, or anything that is going on with them? Also I understand that when I receive the confirmation I have to file the I-129F along with more of the G-325A for her and for me. Is this correct?

Also, how long does this process take? I have heard 6 months I have heard 2 years. I understand that alot has to do with your specific case but what is an estimate? I can't believe that the U.S Government would allow this type of visa taking so long that is just ridiculous. 6 months we maybe able to fight through, but two years, that is two years of my marriage, if it ends up that it is going to take over a year would it be a good idea for me to move back to Mexico with my wife or would that cause problems with the papers?

    thanks in advance

USCIS will send you acknowledgement for I-130 (Notice of Action, NOA) that will have receipt number (You can use it to track your status). Then send I-129F along with copy of NOA but you do not have to send G-325A again but keep record of any related info on this form.
Process time will varies from 6-months to 2-years that depend upon time or individual case and nothing ridiculous about it. Let me provide you some information:
This summer, according to USCIS 1.2 million applications filed. This includes half million (normally 70,000/ month) citizenship applications in July and August alone plus about 300,000 application for I-485 (normally 15,000/ month).
Moving back to Mexico will be your personal choice but how you will keep track of your mails from USCIS and follow-up? If living in Mexico was in your mind then why you did not preferred DIRECT COUNSELOR FILLING (DCF)?

I didnt know anything about DCF.
I guess its too late to do that....

So why the sudden flood of applications?

What would determine if it takes 6 month or 2 years?

Increased in fees for different forms were single most factors for this flood in applications.

Standard wait time is 3-4 weeks after your I-129F received by USCIS and then you will get first notice of action for I-129F (NOA1).
After this start looking USCIS processing time for I-129F (here no control on approval time period).
You will get acknowledgement (NOA2) for approval of I-129F and your file moved by service center to NVC (National Visa Center). 2-3 weeks after you receive NOA2 for approval I-129F contact NVC to find out whether or not they received approved I-129F. Approx. after a month, your case will send to US embassy in your life-partner country.
All time depends upon backlog and spouse country of origin.
