  • What to Do?

    I would like to marry my German boyfriend, who is now back in Germany, and don't know if it would be better for us to marry there, then bring him to the US, or if he should come here first. Does anyone have experience with this? Should we file for a fiance visa first?

    Either you marry him there and file for a K-3 (spouse visa)

    Or file for a K-1 (fiancee visa) and marry him in the USA.

      Sorry...all new to me

      Which way is the "easiest"? For example, would I have to stay in Germany until the process was complete for him to come over? Or do I start the paperwork in Germany and wait for the reply in the US?

        Ask yourself:

        Do I want to wait 7-10 months for my fiancee sitting in the US while he waits in Germany for the K-1 visa?

        or

        Do I want to wait 7-10 months for my husband sitting in the US while he waits in Germany for the K-3 visa?

        Pick one.

            One thing people are not usually aware of are the costs involved in the K-1 and K-3 visa's. Should he get over in any one of those visa's you would have to file an adjustment of status. That steps costs a lot of money. Be sure that you are prepared for that. Please read and look into it. Right now as well, the spousal visa is not taking that much longer than the k-3 visa. As a matter of fact, it takes about the same time for both. Choose wisely. Adjutment of status can be tricky and you can get caught in the name check. You definitely do not want to get caught in that for years. I had been stuck for 0ver 2 years. Finally able to be citizen this Friday coming. Good luck to you and please choose wisely.

              Nothing costly than keeping someone away from loved one. I wish, I should not be married but be in love with same woman and follow K-1 path. This is my personal regret. You choose what you want.

I am so overwhelmed with this whole process, I think we will be married in Germany, then at least we will have that. Hopefully things go well.                   Just wanted to add my 2 cents to the subject.Either visa at this moment,in your case, is fine.The waiting period is something out of anybodys control.Nothing can be done about that.
                  Something that can be done,and I am talking for my own experience is with either visa K-1 or k-3,is the fact to be well prepared for the consular interview,when the times comes and if your petition is approved,of course.
                  One single mistake, a missing document,a red flag in your case, wrong answers to any of the many trick questions they asked,and things could take a total different course,that would leave a very sour taste in your mouth.
                  My fiancee had a little problem at the interview with these questions,and even known she was not approved or denied on the spot, has causing us a very painful delay and the fear that she could probably be denied after all.These people at this embassis,have alot of power,trust me.
                  So I just hope everything goes well for both of you,but please understand that this could be a long process and one need to be very cautious and patient with the whole visa process and issuing.
