  • Can My Child Re-Enter The US?

    My child entered the US under a K-2 visa as his father was my fiance then. His father and I married and we had filed for a Status Adjustment for our kid. DHS sent us a letter with a notice of receipt in October of this year. Since my child is the only grandchild, my mother in law is about to go crazy if she does not see him. So, I was hoping to send my child for a few months to the Philippines before school starts. My dilema: He entered as a K-2 beneficiary and on his visa, it states "One time entry." Would we have a problem with him coming back in August when we pick him up from the Philippines? I was hoping to receive his greencard before August and hopefully that would be okay. Does anyone know?? Please help me out. I am sooo confused! Thanks

    Since Adjustment of Status is pending for child, your child need advance parole (form I-131) but read the instructions carefully especially travel warning.
