  • Advice on my situation

    My name is Viktor A. I was born in Mexico and brought to this country by my parents in 1988 when I two years old. I went through school as an honor roll student even obtained a scholarship from the Governor of California. I graduated high school and even attended a community college for two semesters.

    Along the way, I met an amazing girl who I have been dating for 2 years. Our first child was born in March of this year. As I now have a family, I find it extremely difficult to provide enough without proper documentation. I am not even allowed a drivers license.

    The reason I am not married yet is because I am trying to figure out an effective strategy in finally obtaining my green card. I have not been back to Mexico since my arrival. I have never been in trouble with the law.

    I want to know what my chances are of success. Also, I would like to hear from those who have gone through the process, in fact any help is appreciated.

    Did your parents bring you into the USA legally? do you have a record of entering the country (passport stamp)?

    If you do not, then the road for you to get a GC is VERY HARD. You need to get a good immigration attorney because you have to deal with many complicated matters.

    You can not adjust your status because you have not entered legally, and if you go back to mexico, you could face a 10 year ban from re-entering.

    Get a good competent lawyer.

      Unfortunately, my parents also entered illegally and have done nothing to try to obtain their GC.
      From my research I find the hardest part to be getting rid of the 10 year ban. That is, getting approved for a waiver so I won't have to be stuck in a country I am unfamiliar with for years.
