  • Student visa before fiance visa?

    Greetings and thanks for running this very helpful forum,

    I just got engaged to a girl in Pakistan who is also applying for admission at a school in the US, and chances are she will be able to get a student visa by june '07. I'm hoping to get my citizenship sometime this year, and therefore have a couple of questions in this regard:

    a - If her F1 visa gets refused, will it affect a later attempt by me to get her a fiance visa?

    b - Can I also go ahead and apply for a 2nd visa for her (fiance) while she is in the process of getting the I-20?

    c - While I do visit her country every year, I don't have a visual proof of any meetings b/w us, does it mean I will have to visit her again and get a proof of the meeting before I can think about applying for the fiance visa (in case I do apply for a fiance visa eventually).

    a) no.
    b) you can't apply until you are an US Citizen.
    c) your plane tickets may be enough.

      thanks so much for a helpful reply,

      as for point ( b ), let's say I get the citizenship some time by may-june '08, before she goes for a visa interview for the F1. Should I wait till a decision is made for her F1, or just apply for fiance visa right-away, i.e., as soon as my citizenship comes through.

      Another question that comes to mind is, let's say she can't get an F1, but gets a student visa to Canada, and decides to proceed with that. Now if I apply for a fiance visa while she's in Canada, would it complicate the process (that she's in a 3rd country)?

        1) you can either wait or apply right away, the processing would take about 6-10 months, so you got time.

        2) some embassies do not entertain visas unless the person has a resident status in that country. so, it is hard to predict.
