I entered in US with a visitor visa and married to my fiance, who is a US citizen, 3 weeks later. Our marriage is real and we have strong documentation to prove it. We thought it'd be ok because if we can get a marriage license from the City then if should be legal. But now I learned that the USCIS can see this as a visa fraud if they believe it was a preconceived intent of marring and immigrating. I also learned I could apply for a waiver for my fault to be forgiven.
How is this waiver? What kind of info they need? How long does it take?
What is the success rate for couples that apply for adjustment of status in these conditions?
Should I leave US and apply for the K3 from my home country? Would it prevent us of being suspected of "preconceived intent"?
