    Hi all,

    I understand that if the marriage is less than two years, you will definitely get the Conditional Green Card(conditional resident). My question is. Is this a MUST, a DEFINITELY, an ABSOLUTELY or just majority of the time? In other words, is there a chance to get a permanent resident if the marriage is less than two years. Perhaps, it depends factors like which country a person is comming from, background or how convincing that a the person proved that the marriage is not fraudulent at the interview.

    it is 99.9 % of times this way. It was a law passed to prevent immigration fraud. In some cases of k-3 visas, when there are children and such the condition is waived, but that is the exception to the rule and it does not apply to all cases.

      Who decides whether Conditionnal or permanent? The consular official who interviews you or the person who issues your Green Card?

        The interviewer/supervisor of the interviewer, I have only seen a very few cases where this has happened though.

            ... Don't try to find the 5th leg on the cat.

            It is a discretionary thing, subject to each IO/supervisor/office/consulate.

            You will probably fall under the 2 year conditional card, everyone does.
