K1 Case Returned

  • K1 Case Returned

    I just received an email for the Cairo Embassy stating "The case was forwarded to the National Visa Center to be sent to the approving US Citizenship and Immigration Services for final review and adjudication on December 3, 2007. Once USCIS reaches a final decision, they will contact you directly."

    The case has been in their office for one year, and they have never asked for additional information or given any indication something was wrong.

    What does this mean? Is my case being denied??

    Unfortunately, I do not know the reason. The embassy did not provide this information in their email reply, and I have not received the Notice of Intent from USCIS as of yet. Does anyone know how long it takes to receive the Notice once it is returned?

      The Embassy did not provide my fiance with an OF-194 or any other document. They have also refused to provide me with any information. We're both legally free to marry, no criminal records, no diseases, etc...I can't imagine what their justification is for returning the petition and the NVC has indicated they have not received the returned petition. I guess I have no choice but to wait for notification and hire an attorney.

        Am I allowed to have 2 K-1 Fiance VISA's open at one time?

        Unfortunately, marrying him in Egypt is not an option right now. Egypt requires a form from the US Embassy, which they are not currently issuing. Egypt wants the US to approve/disapprove the marriage, and it's not within their authority.

        I do plan to try and speak with the interviewer (or anyone who might speak with me) when I am in Cairo next week. Not sure I will be successful, but it never hurts to try.

          What are the chances of a second K-1 being approved if the first one is returned by the embassy? Has anyone ever experienced this and had the second petition approved?

          On the up-side, the rules just changed this week and Americans are allowed to marry in Egypt again.

            I didn't answer to your question because I wasn't sure of the answer.

            If you read Clash of the Titan Bureaucracies at http://www.immihelp.com/forum/showthread.php?t=38446, you can file another I-129F, but consulate will simply sit on it until it has received the decision from the CIS on the first or returned petition. In doing so, do remember that after 2 fiance9e) petitions you have to apply for a waiver to file a 3rd, so under the circumstances, if you still want to go with a fiance visa, do not file a new fiance petition.
