  • Can someone point me in the right direction...?

    Hi there,

    I am a canadian citizen currently 'visiting' my fiance in the USA. We have been trying to get me over here, but had a rough spot financially for a few months. Without exact dates, i have been here a 'few months' already. We would like to start the process ASAP of getting me here legally, with a work permit. We have seeked legal advice, but that seemed to confuse us more than we already were.

    I guess my question is this. Is it anyway possible to perform the neccessary paperwork and whatnot, while being here in the USA.

    since you are here "visiting" your fiancee, the best thing is to file for a K1 fiancee visa.

      Right we got that much out of the attorney. Do you think I will have to leave the USA to do any of the neccessary steps before i obtain my K1, Social card, etc. ??

        Yes. You must have medical exams, fingerprints, and an interview in Canada.

        Right now, by only being engaged, this is all you can do.

        If you were married, it would be a different thing.

          Also i have been here longer than the 90 day period. I am not here on a visa of any kind though, as being canadian i was able to drive here using just my drivers licence.

          Does this mean I am Ineligible for the k1, and have to go the I-130 route?

          What happens if i just marry her this weekend, and say "opps" ?

            Consult an immigration attorney. Canadians need to prove legal entry, just like everyone else... and their cases can be a little complicated. Yes, you can marry and file for AOS, but that is not recommended as the best way to do things.
