  • Visiting Fiance

Am I reading the discussion correctly? After you apply for a fiance visa you are not supposed to/allowed to travel to the US to visit your fiance. I am from Canada and my fiance has applied for an application for me to move to the US. I travel back and forth to visit, usually a week at a time, every 2.5 - 3 months.

    Thank you.

You probably won't be able to continue doing so, as you have declared immigrant intent. You can try, but nothing guarantees that you will be allowed in.

Is there a possibility to apply for some kind of visitor visa if I want to go and stay with my fiance while waiting to get my K-1?

Very low chances, but if you can show strong ties to your country (which will be hard once you have filed for a K- visa) you can apply for a visitor B-2 visa that allows up to 6 months stays.

legally u can apply but no guarantee for its approval. not to mention, i have frends still in hongkong, 1 has "approved" petition(i think i130) but no visa# issued to him yet,he tried to get visitor visa but denied, one reason was he no strong tie w/ his country. also my other fren has I129f pending case,no approval yet,his fiancee was able to come back and forth(hk-us) but i dunno until when.
              gudluck!

I know its kind of confusing. I live in the US and just visited my fiance in Sri Lanka. We acutally just recieved approval for our I-129F and we still have all the paperwork and etc to do after the approval. I know that I contacted immigration a while ago to see if he could come visit me here in the US on a vistor visa and they stated that he couldn't have two cases open like that. If you think about it.... if they granted a visitor visa while you were processing your I-129F, you could get married while they are visiting. So they look at it like if your fiance came over on a vistor visa there would be no intention for him to return back to his/her country; which would be considered visa fraud. So from what I was told that is why they would not even consider granting him/her a vistor visa which totally makes sense!

My husband is Canadian and when I called the business visa office to see if he needed a visa to enter the US,the representitive said no! She said as long as he can show he has been entering US for work it shouldnt be a problem. Also, as long as he can prove he has to return to work and doesnt have large suitcases, there would be no reason to be denied. Since Canadians do not need a visa to visit, it is worth a try, as long as you provide evidence of your return back to Canada.

                    Proper visa...

You should be able to travel to the US as long as you have the appropriate visa. If you want to work, have a work visa, if you want to travel, have a travel visa. If you plan on getting married, though, make sure you enter on a Fiance visa. Do not get married without a fiance visa or it can create a lot of hassle.

                      Proper Visa..

I wanted to adjust what I wrote before, but I can't find it. I have heard of applying for multipe visas as looking suspicious, it is definitely not recommended. But, I keep with what I said before, if you are coming to get married, only do it on the fiance visa. The waiting is hard, but oh so worth it!
