    Sorry Ish, I misinterpreted your situation, but for good reasons. One reason is that when replying, you don't see the original post you are replying to in front. Second reason is that I'm surprised the CIS didn't outright deny your petition.

    Assuming the more evidence the CIS has asked for has to do with proof of relationship, and not proof of timely meeting, it sounds like they want to see how persistent your relationship has been for a possible waiver of a legal requirement which requires a meeting within 24 months. But consulate may still make an issue of this and deny a visa.

    CIS will let you know if this proof is good enough for them.

    In your case, you need to show a continuity of relationship between Aug. 2005 and Oct. 2007 so it doesn't sound lke a failed relationship revived by visa. So, do also mail the CIS proof of relationship (printed emails and phone records) dating between this time frame.

    Here's a good example of how one agency (CIS) looks for reasons to approve you while another agency (DOS) looks for reasons to deny you, which makes a case for that consulates should be run by the CIS officials, not the DOS officials, which was the recommendation made to Congress when the DHS was formed.

      So, were does that leave us, do we still have any chance or is it pure waste, there are cases which i have read that even though people have not met there fiance in last 2 years still have got k1 visa's espically from south east asia, your help is appriciated

        I'm going to let PraetrorianXI answer that, but here's the immigration law:

        INA § 214.2(k)(2) -- Petitioner and beneficiary must have met within 2 years - 9 FAM § 41.81(N6.4)

        It's a yes or no requirement. I have a feeling that the CIS will approve the petition due to your special circumstances, but I just cannot imagine this kind of generocity out of consulate.
