Thanks JeanLouis1. Your post was very informative. Based on your post the beneficiary will receive the "packet with instructions" from the consulate. This concurs with my letter from the Bureau of Consular Affairs. I'm not thrilled with the prospect of relying on delivery of documents to my Fiancée's bairro.

Since your petitions's date of approval and mine were pretty close the interview dates should also be close. My attorney after contacting the consulate has indicated that they know my interview date will be in the latter half of May.

Please continue to post updates on your case, for example, to whom and when your "packet with instructions" arrive.

      Hi Blue,

I certainly will post any update in our process.
What was the date of your petition's approval?
I hope that everything goes as smoothly for you as it has been for us. We are not out of the woods yet, but from what I have heard about the Rio consulate, the conoffs do everything to help you succeed at the interview including encouraging and calming the nervous ladies. Typically Brazilian that's why I love the Brazilian people. So if the documents are in order, the interview usually doesn't last very long and is one of the easiest hurdle in the process. We will see and know soon!

Keep in touch too, thank you.
      Jean-Louis.

        What happens next?

My fiance filled i-129f on 14th nov,2008 and received the receipt in two days time and that was on 16th nov.2008.
She called and told me,i should download form G-325c and fill and sign and send to her, which i have sent now.
My question is: what is will be the next step to do? thanks

Your post seems a tad confusing. I'm assuming that you actually mean 2007. The G-325 is required for the petioner and the beneficiary when an I-129F is filed.

To answer your question once the petition has been submiited and an I-797 receipt notice has been sent to the petitioner all that you can do now is wait for some notification from the USCIS, who will either approve, not approve, or request more paperwork from the petitioner.

You can do some preparation for the 2nd phase. That takes place after a I-129F petition is approved.

            Jean Louis,

I am in the same boat as you. I haven't started the process yet because I am not a citizen like you but I will have my interview on May 8th, and hopefully my oath ceremony by may 29th according to my Miami local office. Mi fiance is also Brazilian like yours from Fortaleza, and I am planning to send my package to immigration the same day I have my oath ceremony. I need to ask you some questions: I know Brazilians have their mother's maiden name as their middle name. Is that how you entered it in the application?. Also you said that you prepare your package very well, please elaborate a little bit more, did you use the samples of letters that are in this site?. Also, is Rio de Janeiro the only place to send for the fiance visa?. I also know about the package that your fiance is supposed to get on the mail and I have already printed almost everything and filled out as much as I can. Also those background checks in Brazil are good for how long?, Since I am behind you I would like to learn as much as I can from your experience and add any tip that you can have. I also have to send my petition to the Vermont Service Center for processing.
I am dying to have my fiance here to get married!!!
Thanks for everything and please keep up posted.

By the way, where do you live?
            Regards,
            Cesar

              Hi Cesar,

I will write you a private message later on. I just got back from work. My fiancee doesn't use her mother's name as middle name. I guess you just have to make sure that the names placement correspond to other official documents, but I am not sure... just a logical guess just the same as when you go and get a car title here in the US. I can ask her about that.
I know her daughter Ana writes hers the way you describe it.
I don't know if Rio is the only consulate they use for Visas. It seems to be the case. I have not heard of any other city.
I don't know exactly how long the background checks are good for but I have heard that one month or less is OK.
The forms and letter samples to be filled as well as the instructions are excellent and I have used them for my dossier.
              I live in NC.
Yes, I will keep posting my progress.
              I wish you good success.
              Jean-Louis.

                Jean-Louis,

Thanks for you response, I will wait for your private message, and if it is not too much to ask I would like to call you so we can get in touch. I just want to do things following your pattern so I don't waist time. Anyway like you said at the beginning of this post, you and your fiance thought that the process was going to take longer, and it was not. Like I told you, I am going to have my package ready to mail out as soon as I get a naturalization certificate number. Now the second part is the process at the Rio consulate, I know she is going to get a package on the mail from the consulate, but I want her to be ready and maybe have her background checks ready to send. The main thing here is that I don't want to waste any time and do things as soon as I can. After all this is done, maybe we can give some tips to other people on how to proceed to expedite the process.

                Just a thought.
I hope to hear from you soon, and again Thanks!

                Cesar

                    Hey Blue and Cesar,
My fiancee told me just yesterday that a friend told her that her interview has been set up for May 8th. We sent the Petition I129 F for K1 visa about the same time and it was approved about the same time as ours. I expect her interview will be about the beginning of May.
So the whole process time is what I anticipated from the start, about 6 months from filing the petition to her having the visa in her passport.

Cesar, I haven't forgotten you, I am in the middle of moving and working, so as soon as I can, I will give you more details. But right now you are ahead of the game since you haven't got your Naturalization # yet.
It is very important to take your time in assembling your dossier and not miss anything, like small important details that can delay your process. I will show you later when I have nore time what I have done.

Also it is not necessary for your fiancee in Brazil to get everything ready before a few weeks while you are waiting to get to the interview, remember some documents they require are time sensitive and you cannot get them too early. As for the background checks, my finacee told me that the longest takes 2 weeks to arrive from another city, but if she lived in the same city for a few years, in general it takes a day or so.

From all the threads that you can read, the hardest part is the waiting and not knowing, so it is better in my opinion to be ready for the wait, keep busy adn not worry. Give yourself a reasonable time frame and get busy preparing and make plans for your life together and dream a little. This is what kept us going and kept us from going nuts!!!
If there is a problem, you can get some help and encouragement here or legal help from an attorney if you cannot solve it yourself.

Thanks for the website. I have been on it. They also have great info.
By the way what country are you from and what language do you speak?

Patience, hope and good courage to you!
                    Jean-Louis.

                      Thank you Beth!

                      Thanks Beth,
I haven't followed your process so much these days, but I hope that things are looking better and that pretty soon you and your husband will be together. I have been busy trying to get everything ready to move on the 11th of April. I have been looking for an apartement for my fiancee and me and I am almost sure that my request has been approved.
                      Best wishes to you.
                      Jean-Louis.

                          Jean-Louis,

Thanks for you response. I am from Peru and I speak spanish as well as a little portuguese now, not much though. Like I told you before I am local in Miami living here for almost 15 years. Today I called the Rio de Janeiro consulate, and I spoke with the immigrant visa section, they told me that Rio is the only place in Brazil that they process the fiance visa, they also told me that they take between 30 to 45 days from the day they receive the notification from the NVC until they issue the fiance Visa. It is a good thing I ask, before I was planning my fiance to go to Recife US consulate, but they don't process that type of visas. Also I was researching other way which is the DCP (Direct consular processing), but unfortunately, I don't qualify because I don't live and work in Brazil. Anyway I am seeing a light at the end of the tunnel because now I know that at the most I will wait six months to bring my fiance here. I started to prepare my dossier and I have it almost ready, I only need to attach proof of our meeting which I have, I have been twice in Fortaleza and we meet once in Peru also last year. Please tell me which proofs of you meeting with you fiance did you include in you package.
Please keep me posted an how long does it take for you fiance to get the visa after the interview, Since my fiance had to travel to Rio from Fortaleza, it would be nice to get her visa the same day. Anyway, once you are done with your moving please contact me and tell me a little bit more about your dossier.
I wish you the best and same as Beth I hope you find a nice apartment for you and you fiance.
                          Thanks!!
                          Cesar

                            JL1,
I got a clarification on this matter. The foreign beneficiary is sent the packet of instructions as you have indicated, and according to my lawyer In my case since I have a lawyer involved the lawyer will also receive a duplicate of these documents.

                              Postal strike in Sao Paulo

                              Hey Blue,
I just got off the phone with my fiancee who she announced that since the postal workers are on strike right now, the consulate has advised the beneficiaries to call to find out directly the date of their interview because they do not send the instructions because of the strike. They are posted on the websire anyway.
The time frame is exactly what I have heard about 30 to 45 days after the consulate received the approval from the NVC. You will find a confirmation on
Cesar post last night who called the consulate in Rio and got the timing on the interview date. Also watch for the list of interview dates by RDJ # on the website that will be posted mid April.
A girl who received her approval notice on March 3rd called and the con-officer told her she has an interview on May 23rd.
So you should be OK with the help of a lawyer.
