  • I-130 Filed, Should I File for I-129?

    Hello,

    I've filed a I-130 for my wife who is in India. Ive received an acknowledgement that it was received on Feb 26th 2008, and it is pending and being processed at the California Service Center. Now my question is, how realistic is the processing timeframe and when can I expect to get her in the US? I am a US citizen, and I was also wondering should I also file a I-129 as well? Please advise as I would like to get her to the US as soon as possible. Thanks so much!!

    Most people file both. I didn't.....because I want him to come here as a immigrant (I130) rather than a nonimmigrant (I129F) so that I dont have to worry about Adjustment of Status when he comes here. But.....if you don't mind adjusting your spouse's status if she comes here with the I129F....go ahead and file it. I dont know how much faster the I129F is at this point....it used to be faster but lately....it seems that everything is just about the same. But......it cant hurt you! If the I129K is approved first....cool.....all youll have to do is adjust her status when she comes here and the I130 will still be running on its own so that she can get nonimmigrant status. If the I130 gets approved first, the I129F gets automatically dropped. You have nothing to lose.
