Divorce and K-1 Visa

Hi all,

I have a quick question regarding the marital status of the US citizen.
If he/she is still married and in the process of divorcing, can he/she already file the Fiance Visa Petition regardless?

Is it enough that he/she knows the date when the divorce is coming to force
or does he/she have to wait until the divorce termination date has passed, and only then he/she can start the applying his/her finace's Visa?

The divorce must be final before a K1 petition is filed.
