  • Withdrawing sponsorship

I would like some advice on a fiance visa. If a South American citizen seeks a fiance visa under false pretenses such as let her future husband believe she wants to marry him but only wants him to believe this so she can get here, can he have her deported immediately. They have received her visa and she is on her way to the U.S. We have found out from a friend in her home town that her intentions are not honorable. Does he call the police or an agency with the Embassy if he finds out she has lied to him about her intentions. I need this information for my son.

If the sponsor knows for sure, he can always back off sponsorship.

Also, after getting greencard, you have to again prove at the end of two years that the marriage is genuine. Sponsor can back off at that time too.

I don’t know if you can answer this or not. When a person brings his fiance over to the US they have 90 days to marry or she goes back. Before they get married is it wise to have a prenuptial agreement or because she is not a citizen does she have the rights of any of the property if the marriage does not work out within two years. Does that make sense? They really feel rushed to get this marriage completed before the 90 days but still have some issues to work out. What are your feelings about this. You have really been a great help.

This is a family law question and not immigration law question.

I suggest you consult a lawyer that deals with family law.
