I have a Japanese Fiance and we were planning on getting a Fiance Visa and getting married here in the states. I have talked to a couple of people who have foreign wives and they said that Fiance Visas are a waste of time. They she can come over on a regular tourist Visa because she is allowed in country for 90 days. That we can just get married then apply for Legal Permenant Residence and she will be allowed to stay in country until it is cleared. From my understanding of Fiance Visas its basically the same thing, she gets the visa then after we get married we file a change of status which is the same as the LPR i think. So can you please help clearify this for me. Do i need to get a Fiance Visa or can we just get married? Also if i get the Fiance Visa will she get her LPR Visa faster or is it the same time frame. Thank you for the help.

What these other people suggested is considered fraud. Visitors must have "non-immigrant intent" when applying for admission at the US port of entry, whether they are using the Visa Waiver Program or a tourist visa. They can not enter the USA, knowingly intending to file for permanent residency upon entry. USCIS will consider this fraud and the alien could be banned for life from entering the USA.
