  • K1 Visa process

    Hello all,

I am new to the site, and I just had to join because of all the great information I've read. My fiancee entered the US illegally, and we tried to get an Asylum visa, but was denied. However the judge did not put any "bar" on him for re-entry. The judge actually told him to reapply for a visa or get married. Well we plan on getting married when he returns. I am in the process now for the I-129F, my question is has anyone dealt with the consulate in Barbados? I am hoping the process doesn't take long, since when my fiancee was in the states, he worked and he had a driver licenses and social security number.

Has anyone had any dealings with Barbados?

he entered illegally and yet worked? got a SSN and a driver's license? how did he do that exactly?

your Fiancee probably did not get a bar from the judge... but it actually depends on how long he stayed illegally in the USA... whether he will get a bar when trying to re-enter...

Yes he entered illegally. Yes he has a social security card and DL. He has also held down a job up until his departure date. I have been told he didn't have to leave, but we didn't want to take any chances. I am hoping that since he is already in the system, and we have done everything asked of us, that the K1 process will only take a few months.

My apologizes, I didn't read your reply completely. You asked how did he get a SSN and DL. Well we first applied for his employment card, and then SSN, and then he went to take the DL test and passed. I don't know if he received these items because we were trying to get an asylum for him or not, but he has all of these items and they don't expire until the end of this year, and I am praying that he will be back before they expire. However he has to renew his employment card and DL each year.

I guess no one has had any dealings with Barbados. I will just continue praying that he comes back quickly.

          K1 Visa process update

My finance was in the states illegally. We tried to get him a visa by applying for Asylum, but we didn't have enough evidence, so the judge told him he had to leave the states, and apply for a visa to enter legally. Well he left and I filled out the I-129F application and mailed it off, and we received the approval notice, now we are waiting on the interview at the consulate in Barbados. I am very surprised of the approval because I didn't include the 5 copies of the G25a forms for both of us, only 1 copy for each of us was submitted.

          Mailed applicaton - 5/29/08
          Received by USCIS - 6/2/08
Received email of approval - 1/24/09
Received approval notice in the mail - 1/30/09

I will be mailing him a copy of the approval notice tomorrow 1/31/09. He has requested a copy of the police report showing he hasn't been in trouble. Now we wait for the interview at the consulate.
