    Me and my girlfriend ( us citizen) got married in india and now she wants to take me to US. Can you answer my following questions?

    1. Is it better to apply from india for my k3 visa or she should apply from america?

    2. If her dad sponsors our marriage, do we stand a better chance of getting approved?

    3. Can I go to US temporarily to meet her family as a visitor son-in-law on his sponsorship, because he is willing to sponsor me and her whole family is supporting our relationship.


    Please suggest because I want to be with her always and dont' want any seperation because of political boundaries.

    1. Is it better to apply from india for my k3 visa or she should apply from america? You do not have a choice. You are in India and you must apply there. Through Consular Processing.

    2. If her dad sponsors our marriage, do we stand a better chance of getting approved? The approval depends on the "true/bona fide marriage" more than anything else. If she does not make enough money to meet the poverty guidelines (I-864P) then you guys will need a sponsor

    3. Can I go to US temporarily to meet her family as a visitor son-in-law on his sponsorship, because he is willing to sponsor me and her whole family is supporting our relationship. No. Unless you have a dual intent visa (H1 or L1) you will very likely be denied entry to the USA with a non-immigrant visa (visitors B1/B2).

      I am little confused about the first question.

      You said I have no choice as I am india and I should apply from india. But I thought only my girlfriend can apply for k3 visa.

      If according to you I should apply for visa, then what she is required to do.



      And should she file i-130 from india or from USA.
      Which is better choice according to you?


      I want to tell you something.


      I met a an american lady who got married in india ( through muslim marriage law) and still struggling to get her husband to USA for the past 3.5 years. She suggested that my girlfriend should not apply for k3 visa but instead apply for k1 visa for me. Because it's faster than k3 visa process.


      I want a suggestion from you that should i go with the suggestion of that lady and apply for k1 visa or should I apply for k3 visa?


      Please suggest I am very stressed out.

        You two got married, you can not get a K1 visa (that is for fiancees - not married).

        You have no choice because you can not enter the USA and apply from there. You will send the paper work to the USA, BUT, you must wait in India for a visa (K3 or IR1) to be issued to you.

          If my wife does not make enough money to meet the poverty guidelines (I-864P) then can her dad sponsor us and if yes what documents he needs to send us to support us?


          Can you suggest some tips so that we don't have to wait long ?

            There are no tips to "not wait long". It is a first-come first-serve basis.

            Read the instructions for I-864/I-864A, your wife will still have to submit one of them, even if she makes $0.

              Why can't i go to visit my in-laws in USA?

              Her dad is willing to sponsor me and in my marriage certificate he is my legal father - in - law.


              Can you give me any tips so that i can go there on visitor visa?

                You can not enter the USA on a non-immigrant visa, with immigrant intent.

                Your plan of entering the USA with a visitor visa, but ending up staying there (by filing for AOS) is borderline fraud. It is all about the intent, and you have the preconceived intent to immigrate to the USA, thus, you can not use non-immigrant visas as the first step to your plan.

                There are no tips on how to do this. Filing for a K3 or immigrant visa is the way to go. Your father in law can be your sponsor from the USA, it does not matter. But you must wait for your visa to be approved in India because you got married there. Period.

                    Someone suggested that I can go to USA on tourist visa with my father-in-law sponsorship instead of visitor visa. Is it possible to go there on tourist visa with my father-in-law sponsorship?




                    I want to enter into USA as soon as possible I don't want to leave my wife alone there in USA, can you suggest me any faster way to enter into USA.

                      A tourist visa is still a tourist visa, whether it is self sponsored or by someone else. You can not enter the USA using a tourist visa, with the intent to immigrate!
