  • DIVORCED and FILING 129F K-1

    Hello All,

This is my first post to this website as I have been lurking for awhile. There is nothing better than REAL experiences to use for help. So thanks in advance!

I am 39, been married for almost 18 years and just recently divorced from a Filipina I had sponsored in 1990 and is currently a citizen.

My question is... My marriage has been unofficially over for quite some time and I have had a relationship with my current Filipina Fiancee for about 1 1/2 years. My divorce in the state of California will be "Official" (After the 6 month wait) July 5th 2008. I have all my documents for a K-1 visa for my Fiancee prepared and ready for submittal after July 5th. Will USCIS see my relationship PRIOR to my marriage's official dissolve as a negative? I already have the final divorce decree in hand and like I said, I am waiting till the official date arrives.

Any help or assurance would be appreciated!

    Thanks!

    Relationship prior to marriage

They don't judge your morals at the USCIS. They just want to know if you meet the requirements--US citizen, met in person, free to marry. You do have to submit somewhere along the way if you have ever filed for a visa for another person. It seems like you had a long marriage and doesn't appear to be a visa fraud thing, so that doesn't break any rules or raise red flags. You should be good to go once you get the divorce. In the Phillipeans they do alot of delays and extra checking at the Manila embassy stage, which you could likely be in for, given this is your second Filapina. It could take a little longer. There are forums on the internet with lots of Phillipean specific experience, so you might keep looking for one of those.
