  • American guy (citizen) marrying Indian girl. Please help!

    We met in Yahoo Christian Chat (Sept, 2004).
    Recently got engaged. Had an engagement ceremony, in Mumbai, India (May, 2008).
    Should we file for K1 or K3? Which one would suit our situation?
    Neither of us have been married before and have no children.
    What is the process time for K1 and K3 VISA?
    When should we file, respectively?
    We hope to be together by June, 2009.
    What proofs are required besides pictures and videos?
    What are some common questions asked in a VISA interview?
    What are the reasons for VISA denial?

    We intend on getting a lawyer to help through the process, but would like to know the above so we can make plans. Thank you for your time.

    Well, since you are only engaged, you have no choice but filing for a K1 visa.

      We were thinking about getting married sometime in December this year, but that would further delay plans. One more question...My gross annual income comes to around $23,000. According to the poverty guidelines, that's just above what it mentions for 3 person household, which is $21,000 if I remember correct. (Is my Indian fiance included in this household calculation of 3 people?) The only other person who is dependent is my mother. So including me it would be 3 people. Can my brother co-sponsor incase there seems to be a need to show more funds? In terms of Affidavit of Support what is it that they exactly want?

        $23,000 is enough to sponsor up to 2 other persons within continental USA. You don't need to list your mother, only the ones you are required to support by a court order or previously filed I-864, etc.
        People in the household that are a financial responsibility must be listed.

          Thank you both for your response. I've been checking the poverty guidelines and different sites have different figures put up for 2008. It's funny, cuz one of them says $15,000 for 3, another $17,000 and still another one $22,000.
          Can you give me the link to the exact Poverty Guidelines?

          Also, being as I don't have my birth certificate is a valid passport enough evidance to prove I'm born in the US? What else can be used? Or is there any other course of action?

          How many years of tax papers do I need to show? I read somewhere that the consulate at Mumbai requires 3 years tax papers. I've only been working at my current job since 2006. Before that I was working at another place.
