I understand that if u dont get married married within 90 days u have to go back and leave the us if that happens do i need to contact the immigration or embassy? thanks! hope anyone can give me some advice....

I am already here in us got here last june 26,2008 and the expiration date of my stay is sept,26 2008 .when i look in my I-94 departure record it will expires by sept,24,2008.WE still not married till now and were planning to get married by first week of september and file for adjustment of status by second week of september .MY question is,is it safe and i will not be deported as long as we will get married before the expiration date of my 90 days stay here? thank you so much! anyone can give me an advice ill appreciat it...

You need to marry and file the papers for Adjustment of Status before your visa expires. So get the papers filled out now as best you can so that once you have the marriage certificate, you can mail them in. Find out how long it will take to get the proof of marriage (marriage certificate). Don't wait until after the marriage to learn about filing the AOS or you may not get it done in time. Start that now.

I'm not a lawyer or an expert. I'm just filing like you are, but this is my understanding of the process.
- Your visa expires 90 days after you enter the country. You will get an I-94 when you enter to keep with you to show you are legal in the US until the date on that little paper. Do not lose it.
- The only way you are absolutely legal to stay past 90 days is to have filed for Adjustment of Status...the green card... before your 90 days are up. If you file, then you may stay without being considered out of status. You can show the notice of filing if there was a question that you were past the 90 day date shown on your I-94 paper.
- The only way you can file for AOS is to be married first so you can show your marriage certificate in the papers you file.
That's about all I can say because it's your choice when you do things. You haven't explained why you can't marry and file in 90 days. If it's because of finances like paying for a wedding or renting an apartment, then I would skip the wedding and move in with grandmother. It's most important to me to get the love of my life here to stay without any chance of them saying "NO, he has to go back." I hear EAD is 2-3 months average. AOS can take much longer depending on the backlog of security checks. Even though you mail them together, they don't process the same. Also apply for Advance Parole with the other two (no extra fee) so you can travel back to your home country if you need to before the green card arrives. If you don't have your green card, you will not be admitted back into the country without an Advance Parole document. The K1 is a one time entry.Last edited by nichole; 09-08-2008, 05:07 PM.
