  • Hawaii Honeymoon

I know this question has been asked but this is a slightly different variation.
I am a US citizen, married wife a few months ago in civil ceremony and started the process immediately: sent in I-485, 130, 131 etc. It is now pending. We are having a wedding reception for friends/family and booked a trip to Hawaii.

I know people say that Hawaii is within the United States (risk is only if flight is diverted to another country)...but Hawaii is not within the contigious United States. The main issue is that she is here on a student visa which she has overstayed. That is my worry! Does it matter that she applied for adjustment, that she came legally but has overstayed. Can't a customs agent or what official say that she is not here legally as of right now and give us a hard time.

Thanks for the help!! The tickets are non-refundable

Hawaii to another state in the US is not an international flight. There should be no customs at all. Get off the plane and go to baggage claim. People don't normally carry passports when flying domestically within the states. If you want an official answer call CBP at (703) 526-4200 or 1-877-CBP-5511, press 0 to talk to someone. Customs and Border Protection will know if a flight from Hawaii "needs a passport" (because you probably don't want to talk about being out of status.) I've called them before and the guy was super nice that I talked to.

She needs valid, government issued picture ID to board plane. For many non-citizens, this is their passport.
