  • I-129F info ?

    My fiance needs to send me photos, birth cetificate etc. for the I-129F petition. Does she need to send the same info for her daughter too at this time? We are just getting started so any info would be greatly appreciated.

    You don't need the kid's things now. The first part of the process (I-129F Petition) is mostly concerned with the basics of the petitioner being a US Citizen, both are free to marry, and have met in person in the last two years. So the US citizen has to show his birth certificate for proof of US citizenship. The foreign fiance actually will present her birth certificate when she interviews at the Embassy in her country. It is not needed to send with the I-129F. Her passport style photo is needed for the file now and photos showing you have met in person. The children will be listed on her biographical pages (G-325A) but nothing else about them goes with the I-129F. She sends you now her G-325A biographical info with all 4 pages having her original signature. The pages all look alike and if you fill out one online, it will fill out the other 3 for you by "*****". You can fill them out for her, save to your computer, then email. She will have to print all four pages, sign and snail mail to you.

    Once the I-129F gets approved by the USCIS, it goes to the foreign Embassy. Then the foreign fiance fills out new forms to actually apply for the visa. There is one that says something like: names of children who will accompany you to the US. When she prepares for the interview at the embassy, it's at that point that the children will need passport photos, birth certificates,a medical exam, immunizations (if any are lacking), permission from their father to leave the country (or proof that the mom has sole custody.)

    In the beginning you are petitioning for your fiance only. But her children are allowed a K2 visa because of her K1. At the interview stage, you will have to fill out an affidavit of support for her, but not separate ones for the kids. You will have to count them as people you are supporting, but don't do a form for each person. Hope I explained that well and you're not more confused.

        Thank you. I was wrong just a bit. Her children are named on the I-129F that you send in and they are not listed on the biographical G-325A. Just didn't want you to wonder where the kids names were when you do the biographical. Also, you do a G-325A (4 pages, 4 signatures, 1 photo) for yourself and your information and she (or you for her) also fills out a G-325A (4 pages, 4 signatures, 1 photo) about herself to send in with the original submission of the fiance petition.

          Another I-129F ?

          Thanks for your correction, I've still need to get some of my info gathered. I have another question, once we have all our info together do you know how long it will take before I get an answer to my I_129F petition. The reason I'm asking is that we would like to get married next summer, maybe in July. My fiance is in China, I was wondering if she will have a K1 visa by then or is there a problem applying in China (meaning slower than other countries)?

            Hello again, On question 9 of part A, where I'm asked my prior spouses name, do I use her maiden name? I know, sounds like a dumb question, but I want to get it right the 1st time.

                Another I-129F Question

                I have another question. Do I need to file a G-28 form? The directions say attorney or representative. So I'm not real sure if I am consodered a representative? Any help will be appreciated.

                  G325 Question

                  Hi I know it has been awhile since I asked a question, but I just got my fiance's G325 form form her. I see that there is a couple spaces that she should have put none in. Line 1. File number, should be none. Line 4. Husband or wife, should be none. My question is can I write none in these spaces? Please help it has taken awhile for us to get this far.
