My wife and I are trying to apply for the K-3 Visa. She is a US citizen, I am Canadian. We need to file the I-130 petition. Does she have to be in the US to file this? Her state of residence WAS MN. She has now been living in Canada for the past 4 yrs. She has Permanent Resident Status here and we would like to move back there. We were married in Ontario and now I am getting told by someone that we cannot apply for this Visa since she is not in the USA to file it. Can we not go to the Consulate to file the paper, or even mail the application? If someone has an answer, please email me asap.
