    alright i want to cancel my K1 file. what do i have to do?

    since NVC lost my file and its been one year now did re-apply still waiting no answer so now i am going to K3 that i am going to india and get marriage
    any advice? does anybody know about staying 3 months in india and apply from there?

    plz help?

    If you case is just lost,you should be pressing to get them to find it. You can have your Congressmans's office inquire for you. It is out of their normal processing times and they should be helping.

    If there is a problem with your petition that they aren't passing it through the system because of your names, or backgrounds or whatever then those problems are not going away just because you marry. The process will still hang up for the same reasons. They don't get easier on their rules just because you marry. You will just start over from the beginning and the same thing will happen again.

    So before you spend the time and money to marry and apply for a different visa, you should try hard to get some answers to find out if your file is lost or if it's still processing but they are investigating you further.

      now i find out from NVC that my old case has been send to india on Aug 22 2008 so how long it will take now?

        It takes 2 to 3 months for things to move between the NVC and the USC's. If beneficiary doesn't hear from the consulate in 4 months, s/he should call the consulate.

        Fiancee visas account for 69% of all returned petitions - spouse visas account for only 7% of all returned petitions - Of all returned petitions only 23% are actually revoked by the CIS. Only at the United States Department of State can you remain employed if 77% of what you did was a miss.
