I am a Canadian citizen working for a large company in Canada. The company is offering me a promotional transfer to the U.S as a Supervisor on a L1B work visa.
The situation is the following:
In February 2007, I applied for a K1 visa. The U.S Consulate General in Montreal had begun the final processing of my K1 visa application and I was scheduled a visa interview in Montreal in February 2008. I went to the interview and a few days later received a letter from the office informing me that they were unable to issue the visa because I was found ineligible under the following section, section 212 (a) Illegally committing a theft as a minor.
I had 2 criminal records at the time of the interview: The first was in December 1996, a friend and I stole merchandise from a store, we were asked to pay a fine $265.00. Then 3 months later in February 1997 I stole again and was given a 6 months probation, I had to attend theft counseling at the local YMCA. I am someone who follows the law and made a stupid mistake twelve years ago. Since then I have bettered myself by graduated from college, started a career and most importantly I have never repeated the same mistakes.
After the interview I have apply for my Canadian pardon and received the pardon from the Canadian government. A certificate was issued.
Since March 2008, a month after the consulate interview my fiance and I have ended our relationship. I have contacted the U.S. consulate in Montreal by e-mail asking them to cancel the K1 visa application process. I haven't heard from the office yet other than an automated e-mail reply.
The following are important questions I would like to have answers:
1) Will my K1 visa application affect my L1B work visa application?
2) Is anything else necessary to do on my part in order to have K1 application process cancelled?
3) Since the interview the U.S Consulate sent me a form called I-601. Do I still need to fill out form I-601?
4) Am I considered inadmissible to the U.S on any kind of entry (even visitor or work) or it was only for my K1 visa?
5) Is there anything else I could do to prepare for my L1B visa application by lawyer as they would like me to start working on December 15th, 2008?
