  • 120 day extension do to sickness/& other?

    Hello;
    The first step of our visa was approved, now my financee has been found with inactive TB. I'm thinking of waiting for a while, so that the medicine is either completely taken, or taken for a while, helping destroy the bacteria. The question i have is, how do I try to get the 120 day extention on the approved form. She has to come within the 120 days or it expires. Who do I contact, & what is my reason I should say for the extension. They've gone past the 4 weeks they say it takes to send to her, so I thought i might argue that it's taking too much time. I'm leary of saying i need an extention, because she taking medicine for inactive tb? I'd kind of like an extension for a couple other reasons, but thats the main thing. Any help appreciated in advance.

    I think they will know anyway when she has the medical examination so delaying might not do much for you. They may still require her to have more medication. So that could be two delays. Why don't you just proceed and see what they say she needs to do when they discover it at her immigration medical?

    There's alot of information about the new TB skin testing and treatment of latent TB at the CDC website. That's the US Center for Disease Control. It's mostly aimed toward immigrants who are adjusting status. Google something like Tuberculosis Instructions for Panel Physicians or Tuberculosis Instructions for Civil Surgeons.
    Panel Physician=exam outside of US for visa
    Civil Surgeon=exam inside the US for Adjustment of Status

    Your question- You need a delay because she can't leave the country until summer because her family needs her. Her mother is ill. She can't leave work because she has some bills to pay off. She is waiting for her child to finish school.

      Delay on my part

      Thanks for your response. Would a delay on my part constitute an extension? My father broke his hip two days after I received the notice of approval. While in the hospital, they discovered he has six spots on his lungs considered to be cancer. I continue to work on things for the visa but with all that’s going on, it would be nice to know there’s an extension of time if needed. I thought I could list that my financee is also recovering from illness as well. Maybe something like this?
      Please grant an extension. My fathers broke his hip two days after our approval, & while in the hospital they discovered 6 spots on his lungs believed to be cancer; this at ninety years old. I’m uncertain of timing & the course of future events. My financee is also taking medication, & is under a doctor’s control. Thanks for consideration.

        treating inactive or latent TB is a hype made by CDC. The person is not infective and there is no need to fear you will get TB.
