My fiance and i are waiting for our fiance visa to be approved she lives in canada and we try to see each other at least once a month. but lately when my fiance has been crossing the boarder they have been giving her alot of greif because she is comming across so often.. we need some help on what to do.. i would hate to book flights or plan for her to come here and they turn her away at the boarder.. any ideas of what we can do... please help... also is there anything we can do to speed up the process.. it has been like 3 months and we havent heard anything.. any help would be much apreaciated... thanks

You should have recieved an i-797 lettin you know that they recieved your application and is pending. I don't have any suggestions as for the boarder and all i can say is good luck and use your judgement and if she is not breaking any laws crossing then she should be fine. They usually ask what your business is in the country and if she say she is visiting her fiance, that should be enough. Oh and call the Service Center that you mailed your application off too. i have not received any form but my attorney said they recieved something stating that they received the paperwork. about telling the border people that she is comming into the country im afraid of them turning her back and telling her to wait for it to be approved i have heard this has happened before.. i would really hate to have to wait 6months or a year to see my fiancee...

Ok you are using a lawyer, well you need to ask him about your case, they should have assigned you a case number and with that number you can log on to uscis web site and check your status. Right now it is pending, but if you all have enough evidence it shouldn't be to much longer for them to approve you are probably a month or two in already so if you have to wait it may just be 4 more months. I really wish you and your fiance all the best. As for the boarder I still don't know what to say, but just keep having her come until they turn her away then you will know that you have to wait the time apart. Trust me either way you two will make it. Good luck.

thanks i appreciate the good wishes... i have talked to my attorney and she has stated that we are waiting and thats all we can do. i guess when they turn her away then ill start going until i get turned away.. so you really think itll only take another couple of moths? my attorney is saying possibly longer than the original 9 month quote.. well i really hope you are right i would love to be with her every day. its hard being from the ones you love.. well if anyone has any other suggestions please help us out so we dont face the turn around from the boarder people.. thanks

What she needs to take to show the border crossing Customs and Border Protection officers is some kind of proof that she has strong ties to Canada and give them some assurance that she will be returning back to Canada. They are questioning her because everyone is suspected as an intending immigrant unless they can convince the CBP that they aren't.
She could take a letter from her employer stating that she is working and when she is expected back at work. If she is a student, she could show a student id and proof of enrollment. She could show Canadian bank account, apartment lease showing she still has money and committments at home.
You should have an official receipt from the USCIS showing your application is received. It would have a number assigned to you starting with EAC (for Vermont filers) or WAC (for filing at California.) Ask your lawyer to make a copy for himself and give you your original. You can go to uscis.gov and monitor your case progress with that number, as well as sign up for email alerts. When your petition is approved, another form that looks like the first receipt will be sent out. It's a notice of action saying your petition is approved. You will need a copy of that to send in once she is here and applies for a green card. And read all the guides on this website and get more informed of the process. Your lawyer doesn't care as deeply about your case as much as you do, so don't just sit there with no clue as to the process.
Back to your original question. If she is questioned, she can show the documents that she is going through the legal process to enter the US along with her evidence of ties she still has to Canada. If she is just going for short weekend visits every month, then they should be convinced. If she has no job, no school, no evidence and comes to the US and stays long periods of time, then they are more likely to not believe her. It is always the judgement of the officer.
