Fiance Visa denied

My fiance was denied for his fiance visa because he had **** in his urine. He was given a penalty of 3 years and was told he can return to the consulate after that date. He is not a druggie by any means he just made a really big and stupid mistake!
His penalty is up this year but we do not know how to proceed. Will he need to re-file? Does he call to get an appointment? what are his chances of getting approved now? Please help!
