  • Applying for fiance visa and leaving US

    Hello
I am planning to apply for fiance visa in february. I have few questions if someone can help -
    a) I don't have any income right now but can I still give affidavit of support or can somebody else totally give the affidavit of support or can jointly give affidavit of support with me
    b) Is affidavit of support based on the current income or tax returns ?
    c) At what stage of the process or after how much time approximately the affidavit of support is required?
    d) Is it necessary for me to stay in US after I file petition for my fiance or I can go to India and live there ?. How long I can stay in India ?. Can I do the complete processing from India while staying there

    Thanks

    a) you still need to put in an affidavit even if you make nothing but yes, you can have a co-sponser if they make over the poverty limit
    b) its based on current income but they will sometimes ask to see your past taxes to prove you have had a good income for a bit (not every place asks to see them though)
    c) you need it at the interview stage and then again at the adjustment of status after the wedding
    d) Its not necessary to stay in the states but it may make things a bit more difficult unless you have a place to perminant residence (appartment, parents house etc) where you can stay once you come into the country again. Again they will ask this at most interviews.
