work permit?

Hi,

I am a spouse of us citizen, and I came here on k3 visa with my wife on dec 9.
I was hoping that the port officer would stamp my visa with work authorization but he refuse and then i applied for adjustment of status paying $1010. My case was recieved by uscis on dec 30. My questions are as follows:

1. Normally how long it takes to get work permit since the day of approval. ( should i expect long delay ?

2. I was sponsored by her dad and he gave an affadavit of support saying that he would support us for four months but he is now pushing us out bitching us everyday. Is there any penalty for sponsor for going against his signed affadavit of support?

3. my wife gave birth to a baby on feb 1 and I feel so stuck over here because i am totally immobilised here. I want to support my family so bad. Is there any way i can speed up the process of getting work permit? i can wait for residency card for long but not for work permit. I have no relative here and i am stuck here.

Normally you will get EAD in 60-90 days if your application is complete. You should already have been to an appointment for fingerprints at a local office by now. If you were not sent an appointment letter, then you know your case is not normal and is slowed down. If 90 days goes by, you can schedule an infopass appointment at a local office to have a service request submitted on your EAD case.


A lot of people forget to submit documents showing the joint sponsors citizenship or tax return information. That could delay your application if they have to request it from you. He can not limit your support to 4 months. There is no place to put that on the I-864 Affidavit. You need to download the entire I-864 form and read all 10 pages of it to know what the obligation and penalty is for sponsors. It tells all that in the instructions.
