    Hello. I am engaged and madly in love with my fiancée. I asked her to marry me December 8th and she was deported on December 11th. Yes, deported. My fiancée is 100% Hispanic, born in Mazatlan. She arrived in the US illegally when she was 9. She got arrested when she was 20 and was sighted with a misdemeanor. Her immigration case was postponed until September 2008, and was ordered to leave in 90 days. In two weeks it will be one year since I met her, and nine months since we started dating.

    She lives fours hours away now. We talk to each other nightly on webcam, and I try to visit her at least two times a month. Obviously she can't get a visa or even visit the US on her own now. What is the best course of action for us? I'm thinking the K1 will be the fastest way to get her back here. What about K3? I can easily go down to Mexico and get married. I've heard that K1 is very expensive compared to the K1. Neither one of us have children. We have plenty of pictures and "evidence" that we are legit so I'm not worried about that. What surprises will/could we be forward to by her deportation and misdemeanor? Is it wise to get a immigration lawyer for this procedure?

    Your thread title "have some law questions" indicates your questions would best be answered by a lawyer....a certified immigration lawyer to be specific.

    The people on the forum are unknown quantities to you and we may or may not know what we're talking about. Your case has some complicating issues.

    I can help with one question. The K1 and K3 visas and subsequent Adjustment of Status in the US are the same price. A IR1/CR1 for a spouse is slightly cheaper because you don't pay to adjust status in the US. The immigrant receives a green card and Social Security number and is allow to work upon entering the US, without waiting months for AOS to process.
