  • married with K1 but not wanting wife to become permanent resident

I have married my wife (K1) within the 90 days but plan only to stay in the States 6-7 months before moving to the Philippines. In reading the "K1 Visa Application Process" on this site I saw the following line in the area "After Arrivint in the US" (After marriage):

If uour fiance deos not want to become a permanent resident after marriage, your fiance (now spouse) must leave the US within the origional 90 days duration.

I am currently employed and that contract expires well after the 90 days. It is not that my wife does not want to become a permanent resident, it is that it si not my plan to live in the states that after the contract expires.

I will be filing my I-485 and G-845 next week (we were only married 3 days ago). I am seeking someone who has some information on this or knows who I can contact in Immagrations to discuss this matter further.

She will be out of status in the US after 90 day unless you proceed with Adjustment of Status. So do you mean she is filing I-485 to adjust status. If so, why? Adjustment of status is to get a green card. If she didn't want a green card/permanent residence, then you wasted alot of money to bring her to the US for 90 days, and further money $1010 to file for adjustment if she plans to abandon it without following through to get the LPR.
