  • Nicole...please help?

    i married my wife in philippines....i just sent the I-130 package last week. as i was looking on another site it says that the I-129f should be included when mailing the I-130. I did not send this...it was my understanding that the I-129f was replaced by the new I-130...which is all you need. i hope this is true...or does the USCIS send this form with notification when I-30 recieved? hope you can help....thank you

    It is my understanding the you get a receipt of your I-130 petition. Then you can file the I-129F along with a photocopy of your I-130 receipt notice.

    Then it's a race to see which application gets approved first. If it's the I-129f, then you get a K3 visa. If it's the I-130 you can process for an CR1 visa. At times the I-129Fs were much faster, but timelines change and the two service centers vary on on quickly they process the petitions. Currently CSC is processing petitons for K3 and CR1/IR1 months ahead of VSC.

    I don't know what you mean by the NEW I-130 (it's date is 05/27/08) or it replacing a I-129F. That is unfamiliar to me.

          K3 Spousal process.

          You must have first filed with USCIS a complete I-130 Petition with all of the proper documentation. When USCIS sends you a Notice of Action letter, you will then file an I-129F petition with all supporting documentation.

          Please attach a copy of the USCIS Notice of Action with your I-129F. This is the proper way to follow the USCIS K3 Spousal visa process.
          I went through the process with the help of k1-fiance-visa.com earlier this year.

            Filing I-129F is optional, but that's the only way to get a K-3 visa. They won't send you a copyof the I-129. You have to download the I-129F and prepare all the documentation that goes with it. It's quite a lot of stuff to compile and organize so you should be getting started if you're going to do it. It's a separate lpetition and must be complete, no matter if you already sent some of the same things with the other petition. You have to send a photocopy of your receipt on the I-130 with the I-129F like the previous person said.

            If you don't file I-129F after the I-130, then the visa will be a CR1/IR1.
            It is a slightly diffferent process and that's a different forum.

              Another thing to know is that you have already filed the I-130 form with all supporting documents plus evidence of the marriage and hopefully you did not forget to include a copy of your marriage certificate?

              When you filed the I-130 petition you made a payment but when you file the I-129F petition with again all of the other USCIS forms and supporting evidence along with it you do not need to make a payment that is what the Notice of action receipt is for in conjunction to your I-130.

              Remember while filing the I-129F you need to include your wife's married name and not her maiden name their are a few sections you should study about this in I-129F instructions before filling it out.

              You must include with your I-129F petition all USCIS Forms also such an I-134 Affidavit of support, I-864 also, original copies of G-325A Biographical information 4 of you and 4 of her.

              This should keep you busy for awhile and I learned all of this through [URL="http://www.k1-fiance-visa.com/"] These are very honest people to deal with.

              PS: Don't wait for the USCIS to send you an I-129F form you must get that yourself download it then type in your answers is the best but make sure you received your Notice of Action first???

                Part of the above is incorrect information. You do not submit an Affidavit of Support (I-134 or I-864) with you intitial I-129F petition. An I-134 with supporting financial evidence will be taken to the Embassy at the time of the K3 interview. It does not go to the USCIS.

                Once in the US on the K3, and applying for Adjustment of Status (green card), then the I-864 Affidavit of Support is sent to USCIS with that application.


                For your further consideration, the K3 visa used to be a much quicker way to get the wife into the US. However the CR1/IR1 visas are processing much faster than before because the NVC has streamlined their process. Your wife would be totally approved for a green card and social security card and able to work immediately upon her entry into the US. You would not have to pay for Adjustment of Status ($1010) and wait at least 6 months and go to another interview. You would pay additional fees to the NVC for processing the CR1/IR1 and she would still interview in Manila. You might want to go to the forum for CR1/IR1 visas and see if there are any recent Philippean experiences posted there to help you decide.

                    Also need passport photos, proof of meeting in person in the last 2 years, and some documentation of your relationship.                       I am all ready 18 , and a citizen of USA, I've been dating a guy for two years and four months now and want to marry him. We finished high school together, and he is from mexico. He came to USA when he was two years old, and He is along with his parents is illegal, so if I marry him, does he need to go back home to get documents? or can he stay here?
                      What papers do I need to fill out for him to become legal?

                      ANY ADVICE???

                        oh yah i forgot the photos, yes, she actually included 3pcs each of our passport photos in the I-129F application. we're both single by the way. i just checked the status of our case online yesterday and its pending still, i think it will take time to process...needs patience. thanks
