  • I-195/K-1 assistance!

    I am a U.S. citizen and my fiance is from England. He and I have been together for over 2 years and we have visited each other back and forth and he was visiting me from January 2009 up until last night. We made the decision that we wanted to get married. We filled out the I-129 application and submitted same to the Vermont Service Center about 2 weeks ago. I am now seeing that there are other numerous documents that should have been sent in, along with the application, which we did not realize. I am of course, really upset now because I didn't know that we had to supply all this other documentation which we would have, if I would have known that they would want a complete package.

    Has this happened to anyone else? The USCIS did cash our check and assigned us a receipt number. Should I just submit the rest of the information to them right away and reference the receipt number? Unfortunately, you cannot contact an officer which is really frustrating!

    Any assistance would be greatly appreciated! Thank you!

    What is the I-195??

    If your application is missing documents, then they'll send you a letter requesting the missing documents (as far as I know). I don't know whether sending it now would work.

      On the reciept from the petition there should be a phone number on the bottom. I filed my fiance's in California and there was a phone number I called because I had several questions. You can try it since it's a 1-800 number it might redirect your to Vermont. 1-800-375-5283. But I think they will contact you with the information you are missing. I think the only thing that happened is it lengthened your processing though it won't be processed for a while and is just waiting around.. Let me know if I can answer anymore questions.

        as far as i know and based on some researches, the USCIS will still give you notice after you sent your application for visa requiring updated documents which you really need to submit with the latest form you can have, for example is the income-tax return which i believed the USCIS will require the latest file you have. since forms like this can be outdated by the time you might receive your next notice. (correct me if im wrong) goodluck...

          It has been almost 2 months since our application was received and I finally got a receipt from VSC, although I had to call customer service and request it

          I understand that these things take time, but it is really frustrating, as I am waiting for SOMETHING from them, as far as what specifically they want from us, to get this moving along. We are lucky enough to have the money to travel back and forth to visit each other, but it certainly isn't the best way to live.

          I really feel for everyone on this forum who are in limbo like my fiance and I. It is extremely difficult to be away from the person who matters most in your life, because of geography.

            You should study up on every step of the process because it will be shorter if you get everything right the first time. Each time you leave something out, then it's going to delay you.

            Once you get approved at VSC and the file gets to London, you will need the documents listed here

              Unfortunately, I didn't know that I needed to submit all of that documentation right off the bat. I just submitted the I-129 application along with our check. We did get a receipt number, but quite honestly, I am annoyed that they cashed our check without having everything they supposedly needed. They should have sent the check back to me with my application and documented what else I needed. As I never dated, let alone was engaged to someone who does not live in the United States, I was completely unaware of how the process worked.

              I assume this is going to prolong the process even further because they do not have all the proof they need, but again, I don't understand why they would immediately cash our check and assign a receipt number, if they didn't even have close to what they need to prove our relationship and intent to marry.

                Would suggest you collect all the documents and send them along with a copy of your receipt notice. And even try to call them. This might save a bit of your time till they come back and request for evidence (RFE). Good Luck!
