work permit ?

hi,

i received a work permit in march which is valid till feb 2010. I am here on k3 visa and i read somewhere is that after it's expiry they don't extend it. I was expecting my gc interview in april but they cancelled it.

1. can you tell me what can i do after the expiry of my work permit ?
2. and how long should i expect them to reschedule my interview..............does it takes really long?

3. i have paid 1010$ for permanent residency card and i expect it to come before my k3 visa expiry,......are there cases where they delay it so much that your k3 visa expires or they have to give it to me before my k3 visa expiry.

i am confused .....i don't know what are they upto..........can anyone suggest me someways to get out of this long delaying process or i am stuck with waiting

1. You can renew your work authorization because you filed the AOS and thus showed intention to switch to a permanent resident

2. I don't know about the rescheduling. Maybe you should ask USCIS.

3. It is ok if your k3 visa expires while they are processing your AOS. You are not required to do anything unless you want to leave the country.

thanks for your replies, I am feeling better now. I have last question : you said that if k3 visa expires i don't have to do anything. what does it mean actually?
does it mean that they will extend my visa or after expiry i don't have to be deported?

1. would i get extension?

2. or i can stay after expiry of visa?

3 if there is extension of visa...............what is the fee for that?


hopefully i will get my green card by then, but i still want to be prepared and informed.

You'll only need to extend your K-3 visa if you want to leave the country so that you could re-enter. You need to file form I-539. Another option will be advance parole. However, if you are planning on staying in the US, you are fine. You don't need to do anything.

That's a very general question!???!! Did you enter on a K-3 or a K-1? did you apply for adjustment of status??

If you are a K1, your I-94 expires after 90 days and you can not extend or renew it. You are expected to be married before the expiration. When you file for AOS, then you are allowed to remain in the US, even with an expired I-94, while a decision is made on your AOS. Your status is "AOS pending."

A K3 gets a longer I-94, but if it expires while you are waiting, you too are legal if you have filed for AOS and it is pending. Once a decision is made and if it were denied, then at that point, they would ask you to leave the US.

For the one with a cancelled interview, have you called USCIS to find out why they cancelled and when they will give you another interview? You can also go online and make an infopass appointment at your local office to ask your questions if there is a long delay and you think you've been forgotten and your work permit is going to expire.
