  • Advanced Parole (AP) Question

    If my fiance, she will soon be my wife, goes back to China how long can she be stay there. Is there a time limit on the AP? 1 month, 6 months, 1 year?

    She needs to return before the AP expires (usually good for 1 year).

    But most important. She needs to be in the USA for the interview and to receive her GC, what in the world is she going to be gone so long for? she is supposed to be seeking residency in the USA.

      AP Questions

      I apologize for not being more detailed, but my fiance's daughter does not want to come to the US and I don't want to seperate them for a long length of time. So we're hoping that my soon to be wife will be able to go back to China and be with her daughter through the school year. Her daughter is in high school and is apprehensive to come to America. We're hoping next year she will feel more comfortable about coming over here. I am wondering if this is ok with the US government? Thanks for your help!

        It is not OK. She can not be living in China for the next year. Once she gets her GC she is expected to reside in the USA.

        She is going to need a re-entry permit i-131 if she plans on being gone for more than 1 year.

          Can she just travel to china on AP then apply for a GC later?

            No.

            She can apply for her GC later, through consular processing when they are ready to move to the USA.
